On 6/25, I paid $150 (see Invoice) to Undisputed Legal for *************** (therefor, time sensitive) routine. They advertised, "first attempt to be made in 6-7 days." I did not hear from them.I called customer service for the update. She said, a manager to contact me. No one did. Also, I was instructed to send an inquiry to ***************************** twice asking for the update. No reply. Again, I paid $150 for the time sensitive documents delivery.

We received a routine request for service (delivery of legal documents) to ******************************** on June 25th at 2:57 PM. Routine service means the first attempt for service is within 5-7 business days and includes up to three attempts. The request was placed by *************************** through our website (***********************), where she provided all the required information (name and address) for the party to be served in ******. Our website clearly states that while we do not guarantee service, we do guarantee the attempt for service. Additionally, it is mentioned that there are no refunds.
A status update was provided to ********************: "The Process Server made several attempts to serve ********************************. On July 9th, 2024, at 6:05 PM, the Process Server spoke to a female occupant via the Ring doorbell. ******* wasn't home, and she didn't know when he'd be home. A notice for contact was left, and ******* called and left a voicemail after 7 PM requesting a callback to arrange service."
In addition, a manager reached out to *************************** and explained that the delay in a return call was due to the July 4th holiday. Therefore, we are against any chargeback and believe ******************** is responsible for the charge.

On October 13, 2023, ******************************* made a service of process request at our ******** location. During the processing of his request, he was informed about our service options: Routine, Rush, and ***************** ******************** opted for **************** indicating that the initial service attempt would occur within 3-5 business days. The first business day was set to commence on Monday, October 16th. The agreed-upon fee covered up to three (3) service attempts at the location specified by *********************

On October 20th, ******************** inquired about the status of his service and learned that the first attempt had been made. However, there was no authorized individual available to accept service, prompting the process server to schedule a second attempt. At this juncture, ******************** expressed his desire to cancel the service. He was informed that, in accordance with our Terms and Conditions, there would be no refunds, particularly given that the service had already commenceda fact he acknowledged.

Subsequently, ******************** requested the expedited return of the documents. We promptly complied by dispatching the documents via *************** at no additional cost.

Undisputed Legal did not do their due diligence: 1. They claim to have gotten confirmation from a neighbor that the subject resided at the address that the citation listed. 2. I later confirmed that the court provided the incorrect address so there is no way subject address was confirmed by undisputed legal. 3. I personally went to the address and saw the subject does not reside at the address originally provided.4. The server did not attempt to serve at the times that a working class person is typically home (Before 9am and after 8pm on week day). 5. I paid expedited service and it was waste of money because there was clearly a lack of service provided with my case.

      ****** ******** ****** ******* ************ ******** *** ********* ********

      Dear: Sir/Madam,

Please accept this letter as our response to Complaint *******. I understand the frustration of *************************** with her situation, but I respectfully disagree with her complaint that We did not do our due diligence. Let me address her statements one by one.

First, while it is true that we received confirmation from a neighbor about the subject's address, it is important to note that they were working with the information provided by *************************** (see the order form completed by ****************). Therefore, the process server their due diligence by seeking confirmation from a neighbor.

Second, *************************** provided the address does not necessarily mean we should have done their due diligence.  We were working with the information **************** gave us and could not be held responsible (please see our terms and conditions ********************************************************).

Third, personally visiting the address and finding that the subject does not reside there does not necessarily mean We should have done their due diligence. We had reason to believe that the subject resided at that address based on the information provided at the time by *****************

Fourth, regarding the server's attempt to serve the papers, they made attempts outside the typical working hours. This statement is completely false; process servers are required to make attempts at varying times.
Finally, while it is unfortunate that you paid for expedited service and did not receive the service you expected, it does not necessarily mean Undisputed Legal did not do its due diligence. Unforeseen circumstances prevented them from providing the level of service you expected.

In summary, while I understand your frustration with the situation, it is important to acknowledge that Undisputed Legal may have done their due diligence based on their available information and circumstances.

      Sincerely,

      ************** **********;

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

They have not owned up to their responsibility of due diligence. I have contacted the court and they also have informed me that a good process server will always make an attempt during hours of when a working class citizen in home. which is before 8am and after 8pm and Undisputed Legal did not serve at any of those times during week day. If the process server took the time to evaluate the affidavit they would notice that the zip code provided was listed as ***** and if you pull that zip code on ****** maps you would notice that it is associated with ******************************** and not what they say they served at *************************************, which confirms a zip code of *****.

They also indicate that a neighbor confirmed that the party resided at *********************** but there is no proof of this when the court then confirmed the address was incorrect and it was *******************. I believe a refund is in order for this error because clearly the zip code on the affidavit does not confirm that the address they claim to have served was correct.

      ****************,

I'm sorry to hear about the issues you've had with the service of process. It's unfortunate that the address you provided was incorrect, which has caused inconvenience for you.  As a process serving company, Undisputed Legal has the responsibility to ensure that legal documents are served correctly. In your case, it's clear that there has been a delay in the service of process due to the incorrect address you provided, and I understand how frustrating this must be for you, but the process servers only go the the address you provided when placing your order.

Whenever he placed an order, he always received a transaction receipt s e e exhibit A).
However, we regret to say that ************************** recent behavior towards Undisputed Legal has been unacceptable. We had to inform him that we can no longer provide services because we do not operate under any sort of threat (see exhibit B).
On certain occasions, ********************** has sent emails which are not related toservice of process requests and has CC'd Undisputed Legal in those emails. It seems that he perceives Undisputed Legal as his "employee." Our decision to discontinue service to his firm has greatly
upset him, and he has threatened to make complaints unless we agree to a settlement offer (see exhibit C ) .
We understand that ********************** may be under a great deal of stress, but we are unable to provide services when payments are declined, or when requisite original documents are not submitted for filings. We cannot comment on his frustrations with the U.S. Mail.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because these people are blatantly lying about what occurred in recent weeks, namely that their incompetence, lack of real business facilities (they use virtual offices around ******** and other places) directly caused them to lose our mail, not serve certain defendants, or not to file pleadings with certain courts, thus causing several default judgments in rapid succession against us in several different court forums, local, state and federal.

They will not be able to lie to a judge however, if and when we drag them to court to pay for those default judgments, in the tens of thousands (if not millions) of dollars in actual and punitive damages.

Because of our long-standing history of doing business with these people (not withstanding our legitimate complaints as attached herein) we kindly offered to them, pursuant to Federal Rules of Evidence ("FRE") 408 a confidential settlement offer, to complete the jobs that we paid for in advance, but characteristically, these arrogant incompetent idiots refused our offer, calling it a "threat," rather than a reasonable bona fide offer to settle/fix their numerous errors, and so now they may face legal and equitable judgment in a court of law.

      Be guided accordingly.

      Sincerely,

      *****************************
