On October 7th, 2021, Ag-Power, Inc purchased a *2005* used forklift from United Lift Equipment. In spring 2023, said forklift was diagnosed with an injection pump failure. In the process of that diagnosis, it wad discovered the unit was actually made in 1992, and not 2005 as the invoice stated- and customer was told (see attachment). Reached out to salesman and owner of United Lift, and were told they would not buy it back or trade for it. United Lift did agree to pay for the cost of repair to fix the injection pump, which was accepted as a resolution. There were long delays in the process of repair (locating a vendor who can fix the pump, hiring someone to remove pump, delivering pump and having it repaired, pump reinstalled, etc) but it was finally completed in October. Copies of the repair have been sent via email three times to owner (Arcangelo) and he has not acknowledged or paid for repair (email had proven to be the best line of communication thusfar with United Lift). Phone calls from Ag-Power have also been placed to United Lift with no returned communication.Business response

I purchased a forklift from this company on 6/10/2022. A 2014 ****** ***** for $24,500. I live in Indiana and forklifts are extremely hard to come by right now, so I negotiated a purchase with salesman Larry L******* based on the listing for the forklift from their website. This forklift was reconditioned and had some pretty good options. However, when the lift showed up at my door two weeks later it was immediately clear that the lift they depicted on their website and as described by the salesman was not what I received. The lift that I bought based on their website listing, which matches my stock# on my invoice, was to have fork positioners on it. They are clearly shown in the pictures that the salesman and I referenced during negotiation. Also, when the forklift arrived, the rear tires are 2" too narrow. In the pictures, the forklift has the correct tires on it, but the forklift I received has 5" wide tires on it, instead of the 7" spec tires, which leaves the rim of the wheel sticking out 1" to the inside and outside of the tire. Forklift is also missing a rubber floor mat. All-in, to replace these items with labor is probably $3,500. They basically did a bait and switch. Salesman Larry and Archangelo both state that my lift was never to have fork positioners, and that I should be happy with the new tires they put on. I have checked spec on the tires and they are not correct. The listing for the lift that I bought on their website matches the stock# on my invoice, and never was I told, nor does their website say that the pictures may not be accurate, or that you may not receive equipment depicted in the pictures. Archangelo, owner, CEO, I'm not sure what his role is has zero customer service skills and basically stating that I should just be happy I have a forklift. Their behavior after the fact seems that they are used to this type of complaint and go about without a care for their customers.Business response

*** **** did receive the lift as advertised, a 2014 ****** *****. No where on the invoice or the on our advertisement did it specify that there was a fork positioner on the lift. As far as the tires are concerned they are the correct size for this unit and are BRAND NEW. The rubber floor mat was ordered for his unit but unfortunately is on backorder. Rather than hold up the delivery of his unit we will be drop shipping the floor mat to him as soon as it becomes available. The floor mat does affect the operation of the unit in any way. Additionally when the customer contacted us to complain about the fork positioner, tires, etc he also included the attachments herein of both the online listing and his signed invoice and neither reflect the fork positioner. Mr. **** received exactly what was listed for sale on our website.

I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.Attached is the invoice for this sale, which does not allude to any kind of attachments. The machine that I received does have other attachments on it that are not referenced on the invoice. Therefore, the invoice is not an accurate source to determine what was included with the lift or not.
What can be referenced is the listing from the sellers website that was used between salesman Larry and myself when agreeing upon the purchase of this machine. Attached is the listing showing that the machine matches the stock# on my invoice, displays the listed lift with fork positioners and correctly sized tires. Never was I informed that the listing was inaccurate, or that the listing showed a machine that had equipment listed that was not included with the purchase. I have also attached a picture of the tires on the machine that I received, showing the rim sticking out 1" past the tire to both the inside and outside. The tires on the machine that I received are 18x5x8, the correct size should be 18x7x8, as I have found multiple references to support this including the manufacturer of the machine itself, Hyster.
This machine has also now developed an oil leak from a steering cylinder. Per the invoice I was to receive a 30 day warranty with the machine, which I am still under. However, this dealer has not returned attempted communication to warranty their product for this issue either.

This business has not returned any direct contact or made any attempts to remedy this situation, only replying to BBB complaints in what appears to be an attempt to save face. They only offer excuses or say to send us back the lift (meaning that we are then out freight charges both ways, totally $3,200). Unfortunately it appears that this business does not appear to stand behind their warranties and/or deceptive sales practices. From other complaints this appears to be a common pattern of behavior. Regretfully, we accept that we will likely have to elevate this matter to hold them accountable.

The seller has made no attempt to stand behind their sale or honor their warranty; only offering to return the lift on my dime (totaling $3,200 out of my pocket for freight charges, finance charges already incurred, etc. And then I have nothing to show for it). The invoice clearly states this lift is still under warranty and the seller refuses to do anything. It would seem an honest seller would attempt to make their customers happy and stand behind their written warranties and sales.Regards,
