Hidden Oak group accessed my credit report without my knowledge or consent. They do not have permissible purpose as described in 15 USC ****b. See below the permissible purpose for accessing the credit report. Didnt know does not meet the criteria. They are to remove the inquiry from my credit report immediately and if it is not removed and verifiable by myself within 10 days I will file a CFPB complaint and if its still not removed and I will seek legal action.Hidden Oak may communicate with me regarding this Better Business Bureau complaint and for the purpose of removing the inquiry But after that they or their affiliates are not to communicate with me in any manner. They are not to communicate with me directly or indirectly nor are they too direct third parties to do so. This does not include communicating with me for this better business bureau complaint for the purpose of removing the inquiry.15 USC ****b 1. Connection with a credit transactionextension of credit (when you apply for some type of credit), a review (like when a credit reviews your credit file for a credit increase), collection of an account (original creditor not debt collectors because debt collectors dont have an account as defined by law)2. Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:Hidden Oak or their affiliates or associates is not to contact me nor direct third parties to do so.
They do not have permission to check my credit report nor are they to direct third parties to do so.
I am not their customer and I have no agreement with them.
15 USC **** b gives permissible purpose to some creditors in some circumstances to obtain a consumers report. Hidden Oak did not have permissible purpose to obtain my consumer file and thus created damage and loss. According to 15 USC ****b In order to obtain a credit report one must have the intention of extending credit to a customer with their permission. Not only did they not have permission, they were advised to cease and desist. They had no intention of extending credit thus the checking of my consumer report was unlawful. It was found in a ********** court that debt collectors cannot access a consumer report without the intention of extended credit.
Because Hidden Oak chose to violate the law and not remove the inquiry from my credit report as they were asked to do I will file a CFPB complaint and if that does not get the inquiry removed I will contact an attorney to determine an appropriate action against this company.Thank you
In order for the BBB to appropriately process your response, you MUST answer the question above.
Sincerely,
