      I am a 2023 graduate of Ohio Northern University. During my senior year, I rented a house from *********** ***** with 4 other roommates. The lease stated nothing about the temperature we were required to keep the thermostat at over winter break. When we left for break, we used reasonable judgment and kept the thermostat temperature set at 55 degrees, well above freezing. On December 30, we were advised that something had occurred at the house to cause a significant amount of water to come into the house, rendering it uninhabitable. Soon after that occurrence, ***** started sending us texts telling us to contact our insurance carriers to pay for the damage to the property and rent due to him. While I understood that my renter’s insurance would cover my loss of use (to cover my rent at an alternative location) and my personal property damaged by the water, I did not agree that my insurance was to cover *****’s loss of business income or the property damage. I had a family member who is also an attorney contact ***** on my behalf, to advise him of the correct interpretation of the law, the lease, and insurance rights. After that, ***** backed off of his requests. The house was never repaired in time for me and my roommates to move back in during the semester. Regarding the deposit, he deducted $1,449.99 for the following: water damage deductible, drywall damage, and exterior yard cleanup. He was asked for his basis under the lease for deducting these charges, as the lease does not give him a right to deduct these charges, and he would not respond; He did not provide any receipts or proof for his alleged costs; He would not respond to a request for his insurance policy or a request to speak to his lawyer. *****’s last text was to me was “We are not wasting anymore time regarding this matter. Put us on notice, file it with the courts. You have my address. Thanks.” I am seeking the $1,449.99 deposit that ***** kept, so I can reimburse myself and my roommates properly.
