I purchased a 2018 Berkshire pontoon boat with a 100hp Honda motor on it last spring. In our contract it clearly indicates I have a 2 year warranty and free winterizing and storage for 2 year plus a 2 year warranty on the boat and motor. On September 25 2023 I sent a email to *** that works there to arrange my winterizing cleaning. He Berber got back with me so I called the Potage Lakes Marina phone number and *** answered. I made a appointment for October 20 at 3pm for my boat pick up. An hour or so later a guy named **** who claims he is now the owner of PLX Marine said he was not obligated to adhere to my contract and I would have to pay $1000 for this service I already paid for when I purchased the boat. He said they have most of the old employees. I talked to a person today st the BBB AND she could find that PLX Marine is even a company but they are using my customer information from my records from Portage lakes Marine who supposedly is now bankrupt. I would appreciate assistance with this matter. I had to hire a new company today and will have to pay $950 plus tax for my 2023 winterizing and storage when I had a contract with Portage Lakes Marine.and storage

I purchased a 2018 Berkshire pontoon boat with a 2020, 100hp Honda motor on it last spring. In our contract it clearly indicates I have a 2 year warranty and free winterizing and storage for 2 year plus a 2 year warranty on the boat and motor. On September 25 2023 I sent a email to *** that works there to arrange my winterizing cleaning and storage. He never  got back with me so I called the Potage Lakes Marina phone number and *** answered. I made an appointment for October 20 at 3pm for my boat pick up. An hour or so later a guy named **** who claims he is now the owner of PLX Marine said he was not obligated to adhere to my contract and I would have to pay $1000 for this service I already paid for this when I purchased the boat. He said they have most of the old employees. I talked to a person today at the BBB and she could not find that PLX Marine is even a company but they are using my customer information from my records from Portage Lakes Marine who supposedly is now bankrupt. I would appreciate assistance with this matter. I had to hire a new company today and will have to pay $950 plus tax for my 2023 winterizing and storage when I had a paid for contract with Portage Lakes Marine for winterizing and storage. I also had been waiting for corrective action on the bent toe eye that was never addressed.

These individuals who are calling themselves PLX Marine were supposedly employees at Portage Lakes Marine and are using the customer files and accounts to benefit them on new orders and sales but refuse to honor the same customer’s contracts. They are using the same building, records, phone number and email addresses to make new revenue from this so called bankruptcy. I find it unethical and wrong to use my account I had with Portage Lakes Marine for only their advantage. Did they pay the individuals that have lost monies for this advantage with their new venture?

If Portage Lakes Marine did go bankrupt when did this supposed new company buy and acquire my account information and use it to make money. To only proceed as a company for new income while not providing the service I already paid for is illegitimate business actions without buying out the bankrupt Portage Lakes Marine account and records.

      Business response

      10/10/2023

Portage Lakes Marine is no longer in operation.  The business operations were shut down in August of 2023.  To my knowledge there was no sale of the business or any assets to any second party.  Portage Lakes Marine has vacated the premises that it was operating on and is no longer operational.  If there is another business operation in the same location of Portage Lakes Marine's old location they are in no way connected.

As the business has been shut down there are no future operations to be done.
