      **** was hired to complete a brick/masonry project. He completed only half the project and cashed money in full. He has not returned as promised to complete project. He was very difficult to get ahold of following this. He then promised a refund check because he could not/would not complete the project. He never sent the refund and now will not respond to any of my calls/messages. He essentially took full pay and only completed half the project. I feel completed wronged, taken advantage of, and robbed.

      Hello this is **** ********* owner of mikes chimney cleaning and restoration. I am writing this to respond to complaint made by ****** *********. The job was quoted to brick in a hole in the upper level of the house. When called out to pick up the deposit for job customer asked me if I could brick wall inside same hole. I simply replied yes if wanted I could do that also. That was all verbal and wasn't in the bid. If I would have quoted it I most certainly would have done it. While doing outside work customer informed me that she wanted the inside done. She also insisted that it was part of the job, I again told her that it was not in the estimate given. So I was paid for the work done and completed. I do not feel I should be liable for any other work that is not in my quote. Sincerely **** *********. Thank you

       I am rejecting this response because:

      I had **** out to quote 2 different brick projects. The first one was not needed. He came back out to quote the job that is referenced in this complaint. I showed him it is a double layer brick wall that needed to be replaced. He verbally quoted me and refused to write a new quote stating it was no problem to complete. It was clearly stated that the brick project is a double layer wall and he said it would be done this way. Only one layer of brick was done and is clearly incomplete on the inner side of the wall which is visible inside our home. There is still plywood in place where brick was suppose to be placed. There would have been no question that this was part of the project to be completed. He stated after coming out on day 1 of the project that he would be back in 1 week to complete the rest of the project because “he did not bring enough brick with him”. He never came back out and continued to provide future dates he would come back out to complete the project and never showed (on multiple occasions). He then stopped responding to any of my phone calls or messages. On one phone call he said he would send a refund check because the project could not be completed “due to a medical injury (knee injury)”. I never received this refund check. And he has ignored all future calls/messages regarding this. This is clearly a half competed project that he was paid in full to do. This is wrong and fraudulent, and I expect a resolution from this whether it be a refund or project completed. I now have to pay another company to finish the work he never completed and he was paid in full. He will likely do this to future clients and I want to prevent this.

      Hello this is **** ********* from mikes chimney cleaning and restoration.  I am responding to the complaint.  I did text and conversation with complainants and got nothing accomplished.  Asked for copy of estimate which she does have but says it was a verbal quote, I didn't and do not do work with verbal quotes.  I asked for the picture copy because I have not found my book for the estimate. She refuses to send it because I know it is not on the paper work to do double wall. I tried to tell her that when I did outside work but did not wNt to listen.  Work was completed outside and customer paid balance for the job quoted.  I feel I am not responsible for inside and refuse to be in contact with customer.  Sincerely **** *********......

       I am rejecting this response because:

      **** is unable to find his copy of the quote because it WAS a verbal quote. I have an original written quote from another estimate he provided on a separate brick project for my home.  He came back out a second time to quote for the project in dispute, and gave verbal quote.  I clearly stated that the part of the home needing repair is double brick. I showed him the interior of the home. It is more than obvious that when repairing an open hole in a brick home that both layers would need to be closed and repaired. There is no excuse to say he would not have known about this or realize it would need to be completed. In addition, the written quote I have from him (for a separate project) is significantly less cost than the job he started on our home. He quoted me nearly $700 more than his initial written quote. So if he would like to go by the original written quote on paper, then he should provide a refund for that additional cost. And as stated prior, after **** came out to start the project, he CLEARLY stated he would be back in ONE WEEK to finish the project, but never showed.  He demanded payment before returning to finish, stating “he would only need a few hours to finish the work the following Saturday”.  He never came back out and provided multiple excuses for not returning to finish project. He then stopped answering any of my calls/messages. Why would he have said he was coming back to finish the interior if he had not agreed to this? I have witnesses to him stating he would come back to finish the project. He is clearly lying when stating we never discussed this.  I have tried to reach out multiple times to him. I was ignored for weeks then promised a refund which he never provided. He is now changing his story. This is not right, and I feel completely taken advantage of.
