Wrong windows installed they sent me a check for the 1st payment and it bounced

3-5-24 measured windows installed after that two windows were supposed to be slider and they installed ones that are up and down. I can't even lock them because the top of the window slides down, it isn't the right size for the space. The window is coming apart already.

      Good Morning,

The contract of service that was written was for repair and replace 12 of 15 windows with 12 double payne thermal tilt in windows with security latches, which she signed and agreed to.  What was installed were 11 tilt in windows and 1 slider. The job was finished April 15, 2024. Our contractor went back out to adjust one bedroom window, (out of keeper).  June 14th, she called said she was having trouble with a window top.  Our contractor went back out to show her how to use the windows, she kept taking them out of the keeper.  Our contractor again went out June 19th, he checked the windows and said there was nothing wrong with any of the windows and everything was working just fine. He stayed there for 15 minutes and the windows did not slide down even one inch. Her response to this visit from the contractor was that he never showed up and then just started making false statements of what he said and did or didn't do.  Now she is complaining she should have gotten all sliders instead of the one (which wasn't part of the original agreement).  She's claiming our worker told her a wrong window was put in -which didn't happen, claimed our contractor told her to contact BBB. She has just decided she wants all sliders in and wants new windows.  We did what was contracted for and if she has decided she wants something different and wants to pay for it.  As far as the bounced check - we made her first payment for her installment plan (it bounced which was not intentional) we took care of this along with sending her a separate check for the bank fees. This was done as a courtesy since it took a little longer for the windows to come in.

We had the roof replaced summer of 2021, in the winter of 21-22 our gutters had huge ice buildup and getting behind the siding and gutter, soffit and fascia. Sent email on February 15,2022 to Craig Parker with pictures to EZ Acceptance and called them. Was told not their problem. Numerous calls and emails, to be told (from pictures I sent- they have never come out to inspect) that it was a hole in the gutter and not their problem to just an old gutter. They said they will have someone look at it. Lied and said a guy came out and put a ladder to my house and went up there and found nothing. We were home and the cars in drive- another lie! I told them it is roofing material behind my gutter causing the issue, they then call my husband saying she figured it out. To date the garbage roofing is still behind my gutter causing damages to my house, getting water behind the siding etc. Tracy tells me one thing, calls my husband and lies to him. Her stories are different each time we speak to her. I want them to pay for the damages and more!

If you look at the 1st pdf you will see the *******'s house. It clearly shows that their soffit is not vented. The 2nd and 3rd pdf's explain that icycles and ice dams are caused by too little insulation and/or ventilation. They are not getting icycles from the installation of the new roof but from lack of insulation and ventilation. We removed 3 layers of roofing and replaced it with 1 layer. The 3 layers actually added some insulation, when we removed them and only replaced it with 1 layer it allowed icycles and damming due to their lack of insulation and vented soffit panels. We thought that there could be some roofing debris left in the gutters that added to the problem, but Tim went there to look at the gutters. He said there was no problem with the roof installation and gutters had no roofing debris in them. Adding to their problem was the fact that we had some really cold weather and snow the winter of 21-22. Most people had a lo of icycles,. In fact, they kept putting out warnings to stay away from the large icycles because they are very dangerous and not to try to remove them yourself as they can cause damage to you roof, gutters and siding. We would be more than happy to send another crew to look at the roof, either now or when it gets cold again, but the truth is that it has nothing to do with the roof..... it is lack of insulation and/or ventilation inside the house and soffits.

********* ******* ********** *** *********** Constituent took out a loan for $20000 thru EZ Acceptance Builders Inc. in February 2022. They hired a sub-contractor **** ********* with Top Shelf Development Inc to build a front porch. They only submitted paperwork for a roof and a deck. They did not obtain a building permits and she did know at the time. They performed shoddy work. Her steps did not have a landing or the correct railings. The porch is not attached to the house. He (****) was sent a letter from the Division of Building Standards stating everything he needed to fix and he never responded.

This lady is not telling the truth. We did write a contract for on 2/10/2022 for $19,984.00 (see attached). The work was given to ** to perform (it was written for roofing and a deck which is what he submitted a permit for). On 4/24/2022 a new contract was written replacing the original contract (see attached). A city inspector stopped there after  it was done and said that it was not done to code. He told her that she had to have a 46" x 48" platform outside the enclosed porch to step out onto then the steps coming off the platform. She said that she was not having it done to code because it would take up most of her front yard and we would have to take out her rhododendrum and other plants. She wanted us to finish the inside of the enclosed porch (even though it was not included in the contract). She called the bank who was lending her the money to do the work and complained to them. They put this on the do not fund list until it was resolved. ***** told her it would be $5000 additional to finish the inside of the enclosed porch. We had to make some repairs to the work but Mrs. **** called the bank and told them to release the money to us, that she was fighting the city. She said that she was NOT doing it to code, that it was her property and no one was going to tell her what she could or could not do with it.....that adding a landing then the steps would take up most of her front yard and she was not doing it. On May 2nd the bank released the money for the work we did.

Now because the city is filing a lien against her property for it not being done 'to code"she is blaming EZ Acceptance for it not being done to code (even though she told us and the bank she did not want the landing and she was not having a landing). ***** met with her last Monday and told her that we would redo the drawings and pull the permit , but it had to be done to code whether she wanted the landing or not and that since the landing was not included in the contract she would have to pay for it, but he would do it "at cost".

Mrs. **** has, once again, called the bank, now the Attorney General and the BBB, even though she would not allow the work to be done to code. We have an architect working on the drawings now so we can  get the permit pulled. As soon as that happens we will go back to make the corrections - and ***** told her that last  Monday, April 17th when he met with her.

All of this could have been avoided had Mrs. **** allowed us to do the work to code in the first place. She is the one who said the City was not going to tell her what she could do on her property. She is the one who said she would "fight the City". We are just waiting for the drawings so we can pull a legal permit and get this done to code. It is not going to happen overnight because the architect is backed up....but as soon as we have the drawings the permit will be pulled and we can then schedule the necessary corrections. We want this resolved also!

Mr. ****** on 2/19/2022 1 contact for  covered porch + new roof on side porch. I made a change. ** ********* (?) on early March 2022. I told him I want all the $19,984 to enclose front porch. He had to draw up new plans. Mr. ****** wrote a new contract 4/24/22 I did not know at the time the new contract was not up to CODE. The crew started April 27, 2022 1:30PM - 3PM. June I thought the porch was done, they had to rebuilt the steps, they were upin the dir- 11" drop on last step Roof leaked a few times. When the crew was cleaning up I asked **** one of the workers, why is the porch not attached to the house, on the left + right, you can see light coming in, he said we do all inclosed porches the same, the owner may take it down later, no damage done to the siding, thats when I knew somethings not right! ** the building inspector came out, he called to find out, no building permit, no plan, he said this whole porch was not up to CODE. E-Z seems to only talk about the steps. The contractor got caught June 8-18 submitted the drawings on how he Built it. The drawing was rejected. The whole porch was not up to CODE in the drawing. I have a copy. I talked to ** **** 4/21/23 he told me all the CODE violation that was wrong. he said the porch was not safe. It could fall off the house because on the drawing ** the contractor submitted does not show he attached it to the house. You can get a copy if needed I am faxing all Doc's that E-Z seemed to leave out. I found most of this out April 8th 2023.

***** **** at County of Summit Bld Standards, his phone ************ ** **** plans + inspection of Residential Bld. his no is ************.

***** **** showed me on the drawings last week all that was wrong, including the 2"x4 board on left + right side to support the roof of the porch. It shows on the drawing it was put in the ground 2' to 3' + cemented, It is not cemented, this 2'x4's the bottom of them set on the ground. Mr. ****** want 4,000 from me to do the steps. Please read the contract where it says However if after one year it (???) defective the contractor foots the whole Bill! If the plan was upto CODE the platform + steps included before it was Built!

      Business response

      05/04/2023

Mrs **** can go on and on about not being to code. SHE said she did not want it to code. She said she would not allow the deck off the enclosed porch because it would take up too much of her yard and plants would have to be removed. She said she would fight the city. This is all a mute point. This is going to have to be done TO CODE. As soon as the drawings from the architect are done we will have to apply for the permit, get the approval or variance, if needed, and then do the job. If plants have to be taken out to comply then she needs to move them, otherwise they will be taken out-period. We will not replant them. So since its spring and just starting to get nice this would be the perfect time for them to be moved to wherever she wants them relocated. Everything will be done to code and if it takes her entire front yard in order to meet code then that is what will have to be done. As stated previously, these are all mute points. We are just waiting for the drawings so we can see exactly what needs to be done and then apply for the permit. After we get approval we will go over everything with her and get this taken care of.

***** from EZ Acceptance Builders has been dealing with ************* and his concerns. She has put a call into our supplier (Apollo) and the manufacturer (*******)  and is waiting for their response. We agree that the windows were under warranty and Mr *********** should not have been charged for the repair to the windows. ***** tried to call ************* 3 times yesterday to let him know she was working on it and would get back to him as soon as she had an answer, but either he hung up on her or he was having an issue with his phone and it kept disconnecting ..... I spoke to ************* a short time ago (he called into the office) and let him know that we were diligently working to get his money reimbursed back to him and would put an order in for the cracked sash to be replaced. He was told that we probably would not have an answer today because the rep from ******* had to talk to the president of the company and would get back to us. Our representative at Apollo is out of the country until the 23rd or 24th. We will stay on top of this and update ************** as we get information.

EZ Acceptance Builders from Copley Ohio. A 5 day bathroom remodel has now taken the whole month of October to complete and there are still issues. The tub leaks into the closet and basement my toilet is clogged and my water bill is now $500 when the previous month is was $46. The company has repeatedly given me false hopes of this being done on time the plumbers they use aren’t reliable or timely and they have offered no solution to these issues. Every time we interact it’s they need more time. I even caught the plumber trying to switch out my tile for a cheaper version but then started over once I complained.

***** met with both ***** and her daughter......I had told ***** originally that I could not get a plumber there that day but I could the next day. She wanted someone there so I had to send my handyman to see what he could do. He went after he normally gets off work (@6:00 PM). He let us know that we really needed to get a plumber there. The plumber took care of the water issue and ***** "pulled" the original contractor off her job and assigned it to another guy who will be going there to address all o her concerns. We are dealing with the water department to find out why the bill is so high.... even if the toilet was running that seems be be incredibly high. We had to fill out paperwork for the city and get a statement from the plumber. The documents have been faxed to the city and we re waiting for their response. We will take care of the bill if it is in fact our fault.

***** ****** (Owner of EZ Acceptance Builders) had *** (one of our installers) meet him at ***** ********* to look at the issues. *** says that he has been waiting for ******* daughter to get back to us to let us know when they would be ready for him to come in to correct the issues. I spoke to *** today and he has not heard back from them and neither ***** nor the daughter have gotten back to us to let us know that they had a plumber look at the work and it would be ok for us to proceed.......therefore we are just waiting for them to give us the ok. *** says that he can do it the week of 11/29/21 - 12/3/21 and it will take a day to a day and a half to make the corrections. We are trying to get the water department to lower the bills - waiting for an answer from them but the invoice will be taken care of one way or another. As  for a refund for the kitchen we only got a $3500.00 deposit against all of the work.......they still owe us money. The $3508.00 does not cover the work we are doing there without factoring in the work in the kitchen that we will not be doing..

I am rejecting this response because: This information is not accurate. Every time we talk to someone we get a new story on what they are willing to do to resolve the issue. They do not record conversations or use email to leave a paper trail because no one communicates within the company. No one has reached out to us to advise of this information or to see what the hold up is. It should be their top priority to contact us to finish the work not the plumber. Also we were advised that Max was their personal plumber not an employee of EZ. Per Garfield Heights EZ Builders should have provided a copy of their license to the city and had permits pulled prior to even starting construction. Also the water company responded and said they will not be making any adjustments to the bill as they do not cover charges from the remodel. So we are still asking for the full October/November bills to be covered in full. Also the damage to the floor in the closet and the water damage that it caused to the ceiling directly below the floor which would be the ceiling in the basement needs to be repaired. Craig showed up to the house in his brand new Tesla so I can assure you money shouldn’t be an issue to them.

****** from EZ Acceptance Builders came to my home on April 21, 2021 and gave me a quote for a complete basement remodel, including a bathroom and plumbing. This totaling $34,100. I wanted snap laminate floor tiles and she convinced me to get track master grip strips which are peel and stick tiles. The job was started on May 27, 2021 by **** ****** ****** and. *** also confirmed the track master was good quality and the best thing for basement flooring. It was completed on June 25th. On August 9th the floor began popping up. I realized they did not put a sub floor down. Also I still have sewer flies which *** and ****** said would go away because I was getting all new plumbing. I have been in contact with *** and ****** about the floor but *** has put coming to fix the issue off since August 9th.

The office knew nothing about this repair. This BBB complaint was the 1st notification to us. I spoke to *** this morning. He says that ************** contacted him direct and he has been dealing with this and no one contacted the office about any issues.  *** originally told ************** when she called him about her complaints that he was working in ********** and as soon as he got back into the ************** that he would meet with her and address her concerns. *** has been on a big project in the ********** area and he had to be "on site" for it. *** set an appointment to meet with ************** yesterday (Thursday 9/2)  but was unable to keep it so he let her know that he could be there Tuesday 9/7 (after the Labor Day weekend). He said he would look at all of her concerns and set a day next week that would fit into her schedule to take care of all of the issues and concerns. *** says that she seemed to be fine with that so when I told him about the BBB complaint he did not understand why she had filed it as he has been working with her. *** will contact her to set a time to meet her on Tuesday or whatever day will be good for her to get these issues taken care of. I will let you know as soon as everything is taken care of and we verify she is happy.

I am rejecting this response because:
The response from EZ Acceptance is not a resolution. I contacted ****** (the person who wrote my contract) who is the daughter of the owner. I thought that was the office. Not sure why *** is unaware of my displeasure when a couple months (August 9th) after the job was completed (June 25th), I am already having major issues that I immediately contacted him about. The floor tiles are glued directly to the concrete and there is no sub floor. Thus, causing them to pop up all over the place. *** having a job to be on site in ********** for is not my concern, I paid for services that have been completed improperly. *** did not say he would come today, Tuesday, September 7th. He told me to text him Monday, September 6th. *** texted me today, September 7th at 2:32 to see if I would be home at 4:30 which I was unable to do because of the short notice. He is supposed to come this Friday September 10th at 4:00. Now that the office is aware of the issues, I will keep the BBB abreast of the resolution or lack there of. Please do not close my case.

      Thank you,
