I was in the midst of purchasing a home from eberhart realty and management decided that I didn't want to purchase the home because of things that were unacceptable and requested for not only my money back I also terminated the contract. The realtor ***** ***** is not releasing the 1,000.00 dollars in earnest money back to me. My realtor has been requesting for her to sign the release after she agreed to give my money back but has not. And she stopped receiving calls from my realtor in regards to the earnest money being refunded to meBusiness response

I spoke in depth with my agent ****** ***** about this property and with the brother of **** ****** significant other, who has been a very good friend of mine for many, many years. We also consulted with a real estate attorney just to make sure we were following proper protocol.This property was being sold as is and the buyer was aware of this upfront. The buyers performed inspections which gives them as allotted time period to back out of the contract if they are not satisfied, which they did not do. The buyer waited until closing was scheduled to decide she did not want the property which is unacceptable due to more than 30 days of marketing time being lost by the seller, so the earnest money was retained. We even offered to give them back half of the earnest money in the amount of $500 which the buyer refused. The contract expired since the property did not close and was sold to someone else. Legal counsel was also consulted and advised that Eberhardt Realty & Management acted accordingly.Thank you for your follow-up, please let me know if you should need anything further.Customer response

I am rejecting this response because, she told my realtor that she would release the money back to us. I just sent you the text she sent my realtor
