      I signed my child up for boxing lessons and in the agreement, there is a section allowing you to suspend auto payments where the account would be frozen. I had been in constant contact with the owner, who made several promises including contacting billing more than once on my behalf, and never did, they continued to charge me, and would not refund my money when he promised to. I want my last 3 payments refunded because that is how long I had been trying to freeze my account. Each and every time he promised to do something, nothing happened. I even did as instructed and completed the application to freeze my account which after billing stated they never received, and continued to charge me. He then told me that my account had been canceled, closed and I would receive my refund but to date I have not received.

      I requested cancelation of services and paid the 250 cancelation fee per the contract. The company charged the bi-weekly fee after cancelation fees paid and refused to return my additional fees paid. I have to cancel my debit card because it seems this company will continuously to debit my accounts out side of contract regulations.

      Hello,

      This is in response to a letter that was received regarding a prior client complaint.  ******* ***** signed her child, ********* ****, up for a 6 month membership contract at our gym.  Per the contract, she is required to email our billing department with any requests.  She emailed billing on March 31st and did not provide her son's name nor any identifying information to locate her account.  Once they were able to establish what account was hers we terminated the contract on 4/6 via her paying an early cancellation fee of $250.  As soon as her payment went through, her account was terminated and no further charges went through.  Her card was not charged anything by our company after the cancellation fees were paid.  Please see her accounting detail attached.  Her claim that fees were charged after the cancellation fee is unfounded and therefore we are not able to offer a refund.  

      Please also note that our gym address has changed and this letter went to our old address which led to the delay in providing a response.  Our new address is in my signature below.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      A request to cancel was made prior to deduction date. Ethical companies compliance policies validates and honors written requests made before deadlines. The 109.00 payment should be refunded. I adhered to the cancelation agreement.
