      On May 11, 2022, I delivered a deposit in the amount of $300.00 (a personal check) to Les at the Regal Carpet & Tile on Northfield Road in Bedford Heights Ohio 44146. This deposit was a partial payment for an installation of a new kitchen floor in my home. On that day Les informed me that the material was in stock and he would have the material in his store within two (2) days and the flooring would be installed in my home by the end of that same week. This did not happen! Then the next week I phoned Les to find out what was the delay. After a couple tries, I finally reached Les and he said he was not at the store and would call me back. Which he did not! So, I telephoned him again (another week had gone by) and I called Les again to inquire about the plans to install and complete the requested service. Les informed me that he had been out of town and had caught the Covid Virus. He also stated that he would go into the store and get back to me. After a few days, Les had not returned the call. So, I telephoned him again and he said he would check the schedule and get back to me. During that conversation, I clearly stated to Les that the installers would need to wear masks whenever the service was scheduled. Les told me that they would wear a mask upon entry into my house but would not wear the mask while they are working and that I could leave my house while they work or go into another room or area of my own house while they worked. I then told him that wearing a mask was a requirement not an option. Les stated that he would check the schedule and get back to me. Les did not call me back. Again I phoned Les on Wednesday, June 1, 2022 to confirm that the installers would come and wear masks while in my home or if not then he could just return my deposit and cancel the installation. First he hung up on me and I called back and Les said he would call me back and he never did. Today is June 6, I want and request the return of my full desposit $300
