I hired Eury to remove 4 squares of concrete on my driveway and remove old sidewalk and add a new one. Also add a French drain to be used by 3 downspouts This job started on April 2 of this year.. He only replaced 2 squares and broke of a third and patched it. The 2 squares he did were done incorrectly. He just smoothed it over the other part of the driveway as seen in pictures. The sidewalk is crooked and sinking into the ground. I was told by other contractors that the slope in the sidewalk was to much according to the ADA and I it could effect me selling the home or a buyer being able to get the loan until it was up to code. He only connected 2 downspouts into the ground. His bobcats ruined my yard and I spoke with him about this and he doesn’t think there is anything wrong with the sidewalk. He told me he would finish the driveway and fix the yard and then did not show up or call me. I text him and he said that he wasn’t coming because he couldn’t make me happy! So I got other bids and he said they were to high and now he says he will come the week of June 20 my fear is he tells me he is coming and then doesn’t show up so how many times does that happen before I can do something? The only thing he wants to do is add the other 2 squares to the driveway. He said he would bobcat the yard whatever that means. I’m concerned if he thinks this work is good then if he does come will it be more of the same Shopify work? I have a lot of the conversations in text but there were times he refused to text and only wanted to talk by phone. I don’t have a full address to this business that I would need to sue him if this doesn’t get resolved!

      Dear **** *******,

I in fact was hired to do the job *** ******* has noted, with the exception of the French drain mentioned. The French drain was not included nor an option for this project. This job was bid so far in advance from the time I did the job I honestly forgot she wanted four squares replaced. The bid was prepared October 1, 2021, and pourd April 4,2022. I mistakenly overlooked the fact that I was supposed to replace all four squares and only replaced the two bad ones. In regards to the downspouts, I did replace two, the third I inspected and found it was draining properly and away from the home into a natural drain.

We have had numerous discussions and texts back and forth about the work done. She did express multiple concerns, including her yard. I told her it was my mistake and I would make it right. My intentions were to go back and replace the other two squares and clean up the yard by hauling top soil in and grade it, preparing it for her to reseed. As far as her yard goes, we had to use a skid-steer and excavator to perform the job, that couldn’t have been avoided.

On April 12, 2022, I told her I would be down the next day. On April 13,2022, she told me the yard was too wet and did not want me to come down to fix it yet. I asked her to let me know when it was dry enough for me to come work there. May 11th she requested me to come that week, but I told her my schedule was full and that I should be able to get to it the next week.

Please keep in mind I do not have control of the weather we have had and it has done nothing but rain.

So, I have been hesitant to go back due to the fact that she has requested me not to when it is wet.

On May 23, 2022, I asked what she thought would be a fair price for me to pay her to relinquish me of any responsibility or obligation.

*** ******* said she would get some bids from other contractors and get back with me.

June 4, 2022, she informed me of the two bids she had obtained, one for $6500.00 and another for $5900.00. I figured this fix would cost me $4500.00 to do myself and found those bids to be unreasonable. I would be working there 3 days. I will do this, or am willing to pay her $4500.00 to relinquish me of any and all responsibility.

I told *** ******* I would come the week of June 20th to fix the issues, however, she has since gone to facebook slandering and defaming me on various public websites. Then has further contacted you all. At this point I am at a loss as to what and how to handle this situation.

Thank you for contacting me, I look forward to hearing back on your thoughts/suggestions on how I should resolve this issue.

      Best Regards,

      S. Dale Eury
