      So this started back during the hail storm. There lack of communication. They told us they would give us a break down of the cost of roof and siding they wanted to charge us 25000.00 dollars for a 5000 dollar roof. Which was not done how we asked and we constantly had to contact them and pester them to try and get a dollar amount then come to find out they tell us thats not how we do things very unprofessional company and now they are refusing are money and tryin to pit a lien on us

      ****** husband ***** entered into a contract with our company to work with their insurance company to restore the hail damage to their home.  It is worth mentioning that we have 136 customers from the hail storm who all signed the same contract and were all explained the same process.  The contract clearly states that the insurance companies line item scope with line item pricing is the price they owe.

       

      ACI Construction is a licensed general contractor and the contract states in bold letters that complex claims where the insurance company pays Overhead and Profit is due ACI Construction for services rendered.  This is a very straight forward process.  The insurance scope defines the pricing (not ACI Construction) and that is the money due when the work is completed.

      Installing the new roof they damaged my gutters. They took gutter guards off & did not put them back on. and did not replace the downspouts they were to replace anyway. I don't believe they can be put back on .Nov 8 ,2021 is when the job started I have been waiting for this resolution.

      I, Tim S******* am the owner of ACI Construction and have personally spoken with ****** 3 times.  ****** contacted me regarding a dent that he spotted on a gutter run.  I told him a company cam video documentation is performed before we begin work on a project.  It is not at all uncommon for a home owner to not be aware of a scuff, scratch, dent, ... on their property.  Most of us don't inspect our property exteriors regularly.  Some times we have created damage and must rectify the damage.  In this instance I informed him we would replace the gutter run that was dented if we caused the dent.  During these 3 conversations ****** never mentioned anything about the downspouts.

       

      After researching the company cam video and capturing relevant still shots it is clear the gutter run had a small dent at the same location as is shown in the picture supplied by *******  After receiving this complaint I requested the project manager review the insurance scope that ****** supplied to us regarding the replacement of his wind damaged roof.  To be transparent, I must acknowledge that we only have a single page of the insurance scope (this is what ****** provided us) and there could be additional pages of the insurance scope which he didn't provide us.  The page that was provided to us has no downspouts listed for replacement.  There is only the roof replacement and the corresponding price insurance was willing to pay for the roof.  We replaced the roof and invoiced ****** per the price insurance listed for the roof replacement.  ****** has paid us in full per our invoice and the matching amount on the insurance scope.  We did not invoice for downspouts as we did not replace downspouts as the one page of the insurance scope provided to us did not show downspout replacement.

       

      Our project manager will be showing the company cam video in person with ****** as well as reviewing the single page of the insurance scope he provided us which does not show any downspout replacement.  If there are additional pages to the insurance scope that ****** did not provide us then we will be happy to replace those downspouts identified on additional pages for the dollar amounts shown by the insurance company.
