Upshift Work LLC permanently and unethically suspended my account due to cancellation of a shift during a hospital admission that lasted 5 days from 11/09/2023-11/13/2023. After providing medical documentation multiple times, Upshift Work LLC upheld my ban. If my account is not reinstated with the 2 strikes I had already acquired, I will be filing a formal grievance with the Department of Labor with additional evidence that I have collected from emails in violation of the ADA.Initial Complaint

According to the internet and the ******* Secretary of State, UPShift ******* appears to do business under the Cincinnati location, with their registered agent being in ************, *******. * *** *****, the caterer who provided food at our daughter's wedding on May 11, 2024, hired servers from UPShift to serve the food they prepared. According to the caterer, all of the servers hired by UPShift not only failed to appear, but also offered no notice of, or explanation for, their failure to appear. The caterer was forced to call in, and wait for, reinforcements, and was still 4 servers short for the wedding. This delay and lack of enough servers not only resulted in a delay in food being served to the wedding guests, but also resulted in the food being cold by the time it reached the guest tables. Since the quality of the wedding meal was less than what we were led to believe would be served on this very important day, I requested some kind of a refund from the caterer. On May 23, 2024, the caterer advised me that she reached out to UPShift about refunding us $1,000.00 of their fee due to its failure to deliver the services for which they were paid. I think that is more than a fair compromise. I followed up with the caterer on May 31, 2024, but have heard nothing.Business response

We're sorry to hear that the meal was not up to standard at your daughter's wedding. We understand how important this day was for you and your family, and empathize with the disruption caused by the lack of servers. We know that the quality of service at such an important event is paramount.
We'd like to clarify a few points regarding our involvement and services:
Upshift connects businesses with temporary workers for various events. While we strive to ensure that all Upshifters fulfill their commitments, we cannot (and do not) guarantee that every single worker will show up for every shift. We recommend our clients, including * *** *****, slightly overstaff to mitigate any potential no-shows or last-minute cancellations.
In this case, two of the four requested servers from Upshift did show up and work as planned for your daughter’s wedding.
The only payment we have requested from * *** ***** goes towards paying the wages of those two workers. We did not collect any payment for the servers who did not work.
Our business model is such that our agreements and transactions are directly with the companies that hire us, not with their end customers.
Given the circumstances, we recommend that you continue your discussions with * *** *****. They are in the best position to address your concerns and possibly provide compensation. Additionally, it might be beneficial for them to contact their insurance provider to seek a resolution.
