      I was a renter with this company at their property 'The U on Bagley' in Berea, Ohio from 11/16/2022-7/30/2023. From day one there was some shady practices such as showing me a video with a completely remodeled bathroom and different flooring in the kitchen, which was not what I received in my unit. I immediately sent an email asking why mine was more outdated then what was originally shown in which the response was merely 'renovation materials vary'. I had let this go as I was excited to move into my place. My time there was not bad but I did come across a few other problems such as doors not being replaced, my ceiling falling apart from water damage, and other issues which were never rectified. Upon move out, I turned in my keys early (7/30/2023) as I was taking a new job and needed to move. They let me know that I would be rent responsible until they found a takeover for my apartment. I have email communication with their leasing agent 'Leigh' from 7/24 (before I turned in my keys) confirming that my apartment was already rented because I reached out with my own takeover. The property did not communicate with me after I turned my keys in. I recently received my final move out bill in which I was charged rent for August & September, $166 in late fees, as well as a $110 cleaning fee. I have video proof of the apartment condition when I moved out, showing that it was thoroughly cleaned and taken care of. These charges are all fraudulent as I was told my apartment was rented from their office meaning I was no longer rent responsible and the unit was cleaned. I spoke with Nicole from their office the morning of 9/26/2023 and was spoken to extremely rudely. She told me that many things were left filthy and the charges would stand as it's not their responsibility to communicate if someone backs out, even though I let them know I had someone ready to rent. These actions need to be called out and looked into thoroughly as they are preying on young renters.

      Thank you for making us aware of this dispute.  The resident, ******* ********, submitted her Intent to Vacate form on 6/7/23 specifying she would be vacating her unit 7/30/23 and acknowledging she would be responsible for rent through her lease expiration date or until the unit was re-rented (document attached).  The apartment was leased, but then was cancelled prior that particular person taking possession.  The unit was leased again and in now occupied as of 9/18/23.  Ms. ******** is no longer rent responsible from 9/18/23 through the end of her lease. The Move Out Statement Ms. ******** provided reflects the credit for September's rent from 9/18 through 9/30. 

      The move out charges for cleaning and patching holes are standard move out charges based on the condition of the apartment upon move out.  I have attached the Move Out Inspection sheet as well as a copy of the Standard Move out Charge addendum that is part of Ms. ********'s lease.  I also have attached a few photos, more to follow- we can only attach 5 files at once.  As you can see, Ms ******** was only charged rent unit the day before the new resident moved in, and was only charged for move out damages, as defined in the lease, documented by photos ( 2 attached, more to follow).

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      When speaking to Nicole the leasing manager at the property she let me know I was charged for cleaning the whole stove, washer & dryer, and much more. I can provide the video I took of the unit upon move out showing that these items were in fact cleaned. I also signed a form stating that I was moving out and requested that a walk through was done of the apartment prior to move out so these things may be discussed, this was never scheduled on the properties behalf. I will attach this form to this. 

      In regards to the amounts charged for rent - I was told on 7/24/2023 by Leigh D****** that my apartment was rented. This would make me no longer rent responsible. I was never notified that this person backed out of the lease or that another person needed to sign. I had let their office know prior I had someone who wanted to take over my apartment (my younger brother) in which the response was that my apartment was leased. I will provide the image of this email once again. Please let me know if I can provide anything further on my end.

      My daughter was going to apply for an apartment and we overnighted a check to do so but then the girl she was going to room with found something else. We called them immediately the same day and asked if they could send the ck back to us and we were no longer interested in an apartment. They instead cashed the ck and took out fees for processing her application in which we told them not too. Then they proceeded to mail back a ck 30 plus days later addressed to my daughter and her potential roommate. How on earth is she supposed to cash a ck with another persons name on the ck? The potential roommate lives in Texas and they don’t even know each other! This is really stealing $ from us and it’s outrageous. We went sent a ck for 420.00 and they sent a ck back to us for 350.00 with both girls name on it. It should be refunded the full amount to my daughter **** ***** for 420.00 We asked them not proceed with an application over the phone we cancelled it.
