New Creation Builders drew up a contract to pour concrete for a driveway for $4368. A $500 down payment was made and the rest financed. Now I am being sought after by another company they hired to help them that has nothing to do with our original agreement for $772. This secondary company is coming after me because they cannot get the money from the original company. They have put a lien against my property for something I had no knowledge of for the $772. In order to remove the lien I must pay the $772.Business response

On the date of October 9, 2021 I reached out to Amish Garage Builders to get an estimate for a carport. I paid them the required deposit of $500 cash & was given a receipt. Their representative, Diane, reached out to me to secure more money for the job and I refused. At that point she insisted she would cancel the arrangement for the job and would refund my initial deposit. She promised this check would be in the mail by the end of November. As of today I have not received any check for reimbursement. Today, 12/21/21, after countless attempts to leave numerous messages, the buisness owner Patrick B******* finally called me back, insisting I need to reach out to Diane to rectify this matter because he is unwilling to do so. I called Diane with the owner Patrick on the line with me at 216-254-3527. She did not answer and that answering service was full so you couldn't leave a voicemail. This is theft and is utterly unacceptable. I am demanding reimbursement of my $500 at once.Business response

Diane and her whole family have been down with covid for the last 18 days and then with the holidays has been off work, The only reason we asked to raise the price was because the city required a stamped drawing for her project which was not included in her contract. We graciously let her out of her contract instead of legally holding her to it. and did not own her a refund and yet was willing to do so in good faith. We know how difficult Garfield Hts Building Dept is to work for.
Diane is back to work today and will make arrangements to refund her money after this review is corrected

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
In the company's response, they agreed to refund the deposit after cancelling my BBB complaint. THIS IS UNACCEPTABLE. This company has promised my money to be returned for well over 6 weeks, which was long before the representative Diane got Covid. I will amend this complaint only if and when my deposit refund is received. As a paying customer, I have been more than patient with no cooperation from this company. As of today, January 10th 2022, I STILL HAVE NOT RECEIVED MY REFUND AS PROMISED. This complaint will remain open and active and will be escalated with law enforcement as necessary if this issue is not rectified. This is such a horrible business practice will no longer be tolerated. Looking forward to my refund soon.Regards,
