Additional Information for Painonlinemeds

In December 2021, BBB contacted Painonlinemeds regarding advertising claims on its website.

On their website's Home page is the logo for the Food and Drug Administration: 'FDA Approved.' The BBB Code of Advertising states that the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any claims made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or the BBB.  According to the FDA's website, at https://www.fda.gov/consumers/consumer-updates/it-really-fda-approved, "Misuse of FDA’s logo may violate federal law. FDA’s logo is for official government use only. FDA’s logo should not be used to misrepresent the agency or to suggest that FDA endorses any private organization, product, or service."  BBB asked the business to provide substantiation for this "approved" claim and/or consider removing it and the FDA's logo.  BBB did not receive a reply.

The statement  'Made in the USA' also appears at Painonlinemeds' website. “Made in USA” and similar terms used to describe the origin of a product must be truthful and substantiated.  An advertiser must not express or imply that a product or product line is exclusively “Made in USA” unless all or virtually all of the product is made in the U.S. All significant parts and processing that go into the product must be of U.S. origin and the product should contain no, or negligible, foreign content.  BBB requested that Painonlinemeds provide substantiation for this claim but did not receive a response.

The website's About Us page includes the claim: 'Customers fulfillment is our last point, and that is the explanation has met or outperformed the accreditations for some driving associations that help to ensure that customers are secure and sure when buying from our drug store.'  According to the BBB Code of Advertising, superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests.  BBB requested the business explain and provide substantiation as to how its firm is the safest and most secure from which consumers can purchase, but did not receive a reply.

Its Feedback page includes several consumer testimonials. BBB requested that the company substantiate that these are reviews left by actual customers and asked if these consumers' experiences with the firm are typical, but did not receive a response.

On its FAQ page Painonlinemeds states in one answer 'No you do not need any prescription to buy from our website but we recommend you to consult with your doctor before you use any purchase from our site so that you don't harm your self' and states in another answer 'No you don't need to talk to any doctor before you make any purchase on our site. You can simply choose which product you want to buy and fill your form our our site or call or text us directly the phone number on our site.'
Its Privacy Policy includes the statement 'Customers are advised to and are fully responsible for complying with the laws of their jurisdiction and to obtain a prescription if required and to only purchase and take medications as prescribed by their doctor or as is safe and legal to purchase and take without a prescription.'  It does appear that the medications on this website are of a class of drugs that require a valid prescription.  According to the BBB Code of Advertising, advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact.  BBB asked the business to substantiate that none of the medications for sale on its website require a valid prescription but did not receive a reply.
