I hired Marcum to do a financial analysis of my husband's finances for my divorce. I paid a retainer at the beginning ($5,000) and then more payments. The $5,000 was for them to look into my husband's business and see if it would be worth doing a deeper-dive. In March, 2022, I asked my contact at Marcum, John ********, what the plan was and he wrote back "we are not going to go too much further until we all speak," however we never did "all speak"--I only spoke with John once, in December 2022. On October 31, 2022 I tell John over email "Could you please let me know where we are? I would like to conclude this," however he did not stop. On the same date I ask John "Could you give me an estimate of how many more hours you'll need?" and he responds, "At this point I cannot but once we get the remaining documents I will contact you and your attorney with my thoughts for moving forward before incurring attentional time." I say, "Great--please let me know what you think it'll be before doing more work--and please confer with not only my attorney but with me as well--because my attorney has said that my husband's company doesn't have any money/isn't worth anything, so I don't want to keep digging if there's nothing there." However, John kept doing work and billing me. In December, 2022 John and I spoke on the phone and I told him that unless he was going to officially depose my husband, on the record, that I did not want him to meet with him, and John agreed that he would not, however he did have a meeting with him. On March 6, 2023, in the midst of my questioning the bills because John never even produced a report, he told me "We only did work as directed by your attorney, as he is our client based on our engagement letter." John never mentioned this, even though I kept asking him to stop. My attorneys regularly told me they were waiting on the report, yet they never got one. John claims this is because we settled, but we settled on the first day of trial.
