      I sent 3 Bottles of Kentucky Bourbon to sell, they sold a few months ago, I have tried to Contact the Owner **** ******* about My Money, I have not heard anything from them. I have left Phone Messages with No reply Back. this is Not right. Plus they Have items belonging to Me and No return Plan Yet.

      My experience with Garth's is unfortunately eerily similar to the reviewer below. They have had my property since October 2022 (1 year). I have receive no response/no communication from them in months. I contracted with Garth's Auctioneers and Appraisers to sell at auction 50+ pieces of Roseville Donatello pottery. From the beginning the communication was quite poor. I would leave five+ messages and sometimes even then would not get a return call. On or about October 2, 2022, **** *********** (Garth person in charge) emailed me that the pottery had "arrived at Garth's safely." Despite this, two months later, in January 2023, **** *********** reported 'damaged pieces' which he claimed were from the original packaging (?). Somehow this had not been noticed for two months? Because Garth's/**** *********** had waited months before 'discovering the damage', the 30 day window in which to file an insurance claim had expired. I was not able to utilize the insurance I had purchased for the shipping. Following this, Garth's promised that the remaining pieces (35-45 pieces?) would be sold at auction in June 2023 and I would receive a check from the proceeds of the sale. Since then I have received no communication whatsoever from Garth's and I am getting no response to phone calls and emails to **** ***********/Garth's. I would like Garth's to execute on the written contract to conduct the auction of these pieces (if they have not already been sold). and, to, send the proceeds from the sale auction, after Garth's commission is taken. It is not right that they have had my property for over a year.

      I consigned items for two auctions - April 16, 2023 and May 20, 2023, I was paid for the April 1 6th auction, but have not received payment for the May 20th auction, in spite of many requests for payment. The amount due to me is $2,135. I have a contract dated February 7, 2023, which states payment will be made 42 days after the date of the auction.

      By Dear Madam or Sir: I consigned items to Garths Auction which were sold on April 16 and July 11. The contract provided indicated that I would be paid within 42 days after each auction which would have been May 28th and August 23rd. After numerous attempts to contact Garths to obtain payment (phone, text, and email), I received one call indicating that they did not have the money to pay me. I requested even a partial payment and was told they would be in touch. After no further communications, I am submitting this complaint to the BBB. As per their website, they are continuing to have auctions. They sold my items and have kept the money thus far. I just want the payment for my items. Included is a copy of the contact, a copy of items consigned as provided by Garths, and a letter sent to Garths on August 17th.
