      A contract was signed with Malynn's company on April 15th, 2022 to add a small additional bathroom to our house. Work was supposed to be started on or before June 10th, 2022. She estimated a small project of this nature would take ~3 weeks which would result in the project finishing by July 1st, 2022. We informed her we plan on putting our house on the market the beginning of August. A deposit of $11,055 was provided to her company. The original start date was not met. Over the course of the next month, multiple deadline were not met. The project did not start until July 28th. Things deteriorated from there when it was found out that she did not do her due-diligence to look at our plumbing before estimating the job which resulted in possibly $4k-$20k more to bring our grandfathered septic system up to code. Plans for a bathroom were aborted on August 9th. At this point a smaller project of having the space turned into a walk-in closet was agreed upon. The financial details were not yet parsed out. On August 17th an argument over the cost ensued with Malynn over the unreasonable cost of the project. She informed us that she is a "high-end" contractor that does "high-end" work with normal project sizes of $80k. She cannot scale her business with projects < $10k. Some money was deducted from the original cost and Malynn required an additional $745 to continue working on the project as she needs to pay her workers. We paid this cost since we were well behind schedule for listing our house. Work continued slowly and she claimed work was finished on August 26th without viewing the results. As it turns out, she never paid any of the people who worked on our house, did not complete all the agreed upon items, and the quality of work was not professional-grade, let alone "high-end". We ran out of time for them to to fix all of the problems. We are seeking a refund of $5k which would result in the incomplete project costing us a $7k.

      We care about all of our clients. Unfortunately this client initiated 3 different agreements. We were hired to install a bathroom. We submitted a proposal to include a mechanical engineer. She stated she did not need a engineer that all of her plumbing was to code. We remove the cost. She was happy because this fitted her budget.
      After the plumber was about to submit his plans for the permit. He mentioned the work that was done to her sewer by another company wasn’t in code and it would cost an additional $21k if it didn’t pass inspection.

      The homeowner decided to remove the bathroom from the contract and we were going to amend the contract to remove the plumbing and tile work. We came up with a new agreement however they were in a hurry to post there home for sale.

      The next day the homeowner removed all finish work from our contract even stating they would not allow us to have a dumpster onsite. They didn’t allow us to skimcoat the walls or install trim or paint.

      This point we are in the process of litigation breach of contract. Our attorney will contact the client directly. We have been asked by the attorney not to respond.

      These are blatant lies:

      1) No discussion about plumbing being to code was had.

      2) All finish work was not struct from the contract.

      3) No discussion around skimcoat was had.

      To Whom It May Concern,

      Prior to entering into a contract with ***** ****’s wife. She stated the price was too expensive and she did not need a mechanical engineer. She was informed an engineer can inspect all her mechanicals & submit the drawings for the permit.
      We agreed to remove the mechanical engineer services $-4500.00 and have each trade pull the permit and submit the drawings.

      She told us the building department was with City of Columbus Building department.
      We came back to her residents 3 times took pictures measurements. Submitted the drawings to City Of Columbus after 2 weeks they approved. Upon paying for the permit we were told by The City of Columbus it was out of their jurisdiction.

      We re-submitted the plans to Clintonville Township. The process too another 3 weeks. We successfully pulled a building permit & a Electrical permit for a pamper room with an option for plumbing. We completed the demo, framing and Electrical. We passed the inspections. We sent the plumber the plans & layout for his drawings he was working on. He worked on his plans. He stopped by the residence and pointed out the work that was done to her sewer was not done to code. The owner hired the basement doctors and basement authority prior to hiring us. The plumber stated it might pass if they don’t look at it or it might be grandfathered in. The other company should have brought it to their attention.
      The plumber stated repairing the sewer would be an additional $20k
      I had Covid-19 for 3 weeks. When I returned. The homeowner stated they did not want to proceed with the pamper room. Kelly stated she wanted a walk-in closet and to remove all the plumbing from the contract.

      We modified the contract and the homeowner agreed to the balance.
      The next day when I went to pick up the check. The homeowner greeted me with anger she stated she paid enough and did not want to pay anymore money.

      She was upset I was sick for 3 weeks she stated on her job she is only allowed to have Covid for 3 days and she is a nurse. The conversation was insulting and way too personal. She stated she did not want us to finish the closet. She not wants an unfinished closet. She didn’t want the walls skim coated just drywall hung and mud. We skimcoat a wall after we prime the wall. She stated her husband will skimcoat, paint, install trim and finish the rest. She also stated to remove the dumpster from the invoice that they would burn the trash. Just leave everything as it. With the hostile environment of Kelly screaming. I told her I would return to put the final agreement in writing. She stated it wasn’t needed and wrote me a check and stated final payment. The job was done. She also let me know they are trying to buy another house and place there current house on the market.

      The very next day I received an email stating they wanted a refund of $5k.
      We have hours of planning & review, drawings overhead & expense.

      They have defaulted on 3 different agreements.

      This is currently with our legal department.
