      We signed our agreement 7/5/2020 and paid $4,589.66. After a month, the company began digging holes. Progress was slow. We were told that the deck would be completed two weeks after the second payment of $4,589.66 (at commencement of work) September 26, 2020. The holes stayed unfilled until the spring of 2021. These created a hazard for children in the area. We called many times and left messages when we didn’t connect; they kept promising that they would come, usually within a week. In the summer of 2021, the company installed the posts. According to one of the company employees, the job was done incorrectly and needed to be redone. In the fall of 2021, the company completed some partial work and left materials on the ground. Exposed nails and miscellaneous construction materials are still there. There has been no progress in 2022, even though we have been in regular contact and are always given a work date within a week or so that is never honored. The neighbors have been very patient during this time. They recently expressed concern that the construction materials are degrading the neighborhood. Throughout this time, **** ***** and ******* ***** were our contacts. We were informed that Mr. B**** had a bad accident and could not work. We understood the situation. Later on, Mr. B**** cited COVID as the reason many workers were unavailable. We support small business but this situation cannot continue indefinitely. Our deck is still unfinished and unsafe. We request a full refund due to the inconvenience and potential liability due to the construction materials and, earlier, the holes. We have been unable to use our back door for more than two years as the steps have been removed and the deck is incomplete. There are also no steps from the unfinished deck to the ground and the boards on the deck are not fastened securely. We would appreciate anything you could do to help in this situation.

      I am rejecting this response because the company's reply to my complaint has been the same for the past two years.  We have several voicemails from **** ***** and ******* ***** promising that work would be done, usually 3 to 5 weeks out.  The end of August is about 5 weeks out.  Based on the last conversation we had with the company, we were informed that the end of June was the definite completion date.  Also, no work has been done on the deck at all by the company during 2022.  Our neighbors have been complaining and some have commented that the unfinished deck portion would need to be dismantled and redone due to the fact it would not pass inspection and be unsafe.  As a result, I do not believe that suddenly the company will honor the contract.  Therefore, we are requesting a refund.

      I am rejecting this response because we have had no communication from Columbus Deck Company (Sean B**** or an authorized representative) for a long time.  The project was started in 2020 and we have not received anything from the company regarding what they will do.  We already said we would take some brick paving work in lieu of the deck and we still have not received an email, phone call or visit from any company representative.

      Shane B**** on behalf of the Columbus Deck Company officially accepted the proposed Deck/Patio Project (CDC Job Number: ******) and received the Initial/Scheduling-Deposit of $13,333.00 (Check Number: 3873 - Deposit #1 of 3) on October 26, 2020. Columbus Deck Company officially started our Deck/Patio Project on December 23, 2020 and accepted Start Work-Deposit of $13,333.00 (Chk:3874-Deposit 2of3). Since collecting the two deposits totaling $26,666.00 & officially starting the project on Dec 23, 2020 thru the Date of this letter, Aug 24, 2021, a total of 219 Days. *****, Columbus Deck Company's Associates & Sub-Contractors have been on the job site a total of 22 days over the aforementioned period. During those 22 on-site days Columbus Deck Company Associate and Sub-Contractors have accumulated a total of 82.45 hours. During this time less than 20% of the total Deck/Patio project has been completed. Average hours worked while on-site is: 3.93 Hours per on-site visit.

      I am rejecting this response because: 

      Since the accident over July 4, 2021 weekend, the Columbus Deck Company, LLC and it's associates have continued to perform at a sub-standard level, failed to show up on the job-site on a consistent basis, when they actually show up they are ill prepared to get meaningful work done on the project.  The Columbus Deck Company, LLC and its associates lack the necessary tools, supplies and materials to complete the job in a timely fashion.  Since the July 4th accident, we have been given several project deadlines when the project would be completed.  Each of those deadlines has passed without any significant progress being made on the project. 

      The latest deadline stated by the Columbus Deck Company, LLC and its associates for Completion of our project was August 31, 2021.  Needless to say, this deadline has come and one without the Columbus Deck Company, LLC and its associates making any appreciable progress on our deck and patio project.  The Columbus Deck Company has failed to procured the necessary materials to complete the job and continue to make excuses for not showing up on the job site as promised.

      As I stated in my Termination & Complain Letter, since collecting the two deposits totaling $26,666.00 and officially starting the project on December 23, 2020 thru the Date of this letter, August 20, 2021, a total of 215 Days.  ***** and the Columbus Deck Company Associates and Sub-Contractors have been on the job site a total of 21 days over the aforementioned period of time.  During those 21 on-site dates the Columbus Deck Company Associate and Sub-Contractors have accumulated a total of 82.45 hours.  During this same time period, less than 20% of the total Deck/Patio project work agreed to in the Contract has been completed.  The average number of hours worked for the entire crew while on-site is:  3.93 Hours per on-site visit. 

      We are seeking a refund of our deposit(s) and an Arbitration hearing through the Better Business Bureau and our Attorney, ***** ***** is prepared to proceed with civil action in this matter.
