The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government’s allegations, which have not yet been proven.

On Sept. 6, 2017, the Ohio Attorney General filed a civil lawsuit in Franklin County Common Please Court against Disability Ohio Assistance,LLC and Kelly S. McElravey, individually and doing business as Disability Ohio Assistance, LLC and Ohio Disability and Disability Assistance and JLC Disability Services, LLC, 2688 Shelly Drive, Columbus, OH 43207. Charges filed accuse the business and Kelly McElravey of violating the Ohio Consumer Sales Practices Act and allegedly pocketing client fees that were supposed to be used for disability retirement benefit applications.

According to court records, consumers complained that instead of receiving help to apply for disability retirement benefits from their public pension plans, McElravey missed filing deadlines, lied or failed to provide information about the status of their applications, and did not respond to their complaints. The lawsuit accuses McElravey of unfair, deceptive or unconscionable representations, failure to deliver services, failure to disclose the business’s precarious financial situation, evading contractual obligations, failure to provide adequate customer service, and failure to maintain and return confidential customer records.

The state was seeking restitution for consumers, and end to any violation of Ohio consumer protection laws, and civil penalties.

According to court records, on 12/06/17 a default judgment was granted in the case find the defendants committed unconscionable, and unfair or deceptive acts and practices, and permanently enjoined the defendants from engaging in consumer transactions in Ohio until the final ordered resolution of the case was satisfied in entirety. The judgment stated that the amount of civil penalties and consumer restitution were to be determined at a future date, and as of 4/8/18, the case remained active pending a hearing on motions scheduled for 08/08/18
