      Northland Gate Senior Affordable Housing - on 7.16.2022 a resident of the community called the tow company to have other residents cars towed. The resident got the phone number off of the posted tow sign. The resident told the tow company that she was not the property manager but had the permission of the property manager. This was absolutely not true as I, the property manager was on vacation. This resident was upset because she claimed she could not find a place to park and was sick of it. 3 cars were removed from the property as the resident showed K&K Towing which cars to tow. A visiting/working nurse was one of the cars towed. This person was able to afford to get her car immediately. The other 2 cars belong to residents. ****, a representative of our company, National Church Residences contacted the tow company immediately upon finding out cars were towed and told them a resident does not have authority to have cars told and if they would return. We feel these cars were illegally towed as K&K Towing knew the property manager, ******* ******, did not authorize the tows. I have spoken to a **** and a ** regarding the matter to see if they would work with us to get these cars back. This was on or around 7.27.2022 They were willing to not charge the tow fee but a storage fee of $945.00 for both cars. ****** **** who is my manager has contacted K&K requesting the fee to be removed and the cars returned by K&K. She was told she needed to speak to the owner ****** however ****** or no one from K&K towing will respond to me, my Manager or our attorney. These two senior residents not having their cars have caused tremendous inconveniences. They have had to make other arrangements to doctors appointments, grocery shopping etc. As of this date, the 2 residents still do not have their cars. Since K&K did not have proper authorization to tow these cars from the property we are requesting the cars to be returned by K&K in addition to the removal of the tow and storage fees.

      8/7/2022 Car was towed from Fairgrounds after I went to get kids from fundraising. Upon arrival at the tow yard I was then told it would be $335.00 to release the car. Because I didn’t have the money to pay that amount I asked to retrieve personal belongings like house keys, inhalers, wallet with Id and debit card and I was told I couldn’t get anything from the car without paying the fee. Ohio law • Requires a towing service to provide notice to the owner or operator of a vehicle who arrives after the vehicle is prepared for towing of the option to pay a “drop fee,” or one half the towing charge for release of the vehicle. Allows vehicle owners to retrieve personal items with presentation of proof of ownership without retrieving the motor vehicle and without paying a fee - unless the vehicle is involved in a criminal investigation. Pursuant to Ohio Law OAC 4901:2-24-03. The maximum after-hours retrieval fee that may be charged is $150. OAC 4901:2-22-06. The Ohio General Assembly delegated the authority to set the maximum fees that may be charged for the towing and storage of motor vehicles that have been impounded or towed from private lots to the Public Utilities Commission of Ohio, which set the following maximum fees3 and may be used as a persuasive guide to determine what is “reasonable” under R.C. 4513.70: Manufacturer's Gross Vehicle Weight Rating Maximum Towing Fee Maximum Storage Fee Less than 10,001 $129 $17/day More than 10,001 $216 $29/day
