Contractors took $10K deposit on 1/25/23 and only did a $1,000 temporary repair on garage roof the beginning of February and on 5/3/23 had $3,000 worth of materials delivered to site. I was given excuse after excuse and lie after lie why workers were not on the job site working. Contractor refuses to refund the balance from the $10K. Contractor FALSLEY advertises he is licensed to do siding work; violated Fla statute 489.126(2)(a)1 by not applying for permit within 30 days after receiving $10K and only applied for roof permit on 5/3/23 which wasn't issued due to insufficient information. Contractor has been previously cited for false advertisement.Business response

I have provided receipts to show this owner that over $9600 in materials alone were provided for this project. Along with the work that was provided for the roof repairs and the temporary repairs, this customer owes me money. I had a sub contractor on this job once materials were on site. He was there on a Thursday and did not show up Friday and Saturday, which is the reason she gave me to no longer honor her contract. She terminated my contract late Saturday afternoon. The Monday after she terminated my company, she had hired the subcontractor as the prime contractor and magically he was able to be on site at 8 am Monday morning. This customer has been provided everything needed regarding receipts showing the amount that was spent for this job. The roofing permit was not completed because the owner chose to do a repair. Due to this owners breach of contract and continued negative actions, this will be sent to my attorney in order to initiate suit against her.
There are entirely too many coincindences with the subcontractor being unable to show up as instructed and then being hired and managed to be onsite the very next business day. This project is a complete mess directly due to her actions and now expects me to pay an unreasoonable amount of money. Her calculations are incorrect regarding the values and has been given proof.
A complaint like this should not even be on my record.

I am rejecting this response because:Contractors response is totally inaccurate. NO repairs were ever made to the roof, only a temporary repair to the garage roof. Contractor states that I owe him money, when it is he that owes me a refund of the balance of the $10K deposit.
Contractors comment about roofing permit not completed because I chose to do a repair is absurd! I repeatedly asked him for the status of the permit from the beginning of March up until the time he was fired and was ALWAYS given lame excuse. County records show he applied for a permit the beginning of May and it was NOT ISSUED due to insufficient information! As previously stated, contractor violated Florida Statute 486.126(2)(a).
Contractor states there is a breach of contract.Not true because contractor NEVER gave a contract, only an estimate.
The so called "negative actions" contractor claims are nothing more than FACTS that are being reported to the appropriate agencies.
Contractor sub-contracted to an unlicensed contractor and as a result of his negligence has completely turned this project into the mess it is currently in. It was not because of my actions.
Contractor has NOT provided receipts totaling $9,600 as he claims. He has ONLY provided a receipt for siding materials that total $6,100.
In summary, contractor states a complaint like this should not be allowed to be on his record. I completely disagree and state that a complaint like this most definitely needs to be on record so other people are aware.
Contractor has now sent me a threatening letter.
