      Landsel title was paid to do title work/closing on two properties, the purchase agreements were sent to them to prepare the closings which specifies the terms of the deals, one of the terms is title insurance is to be paid 1/2 by the seller and 1/2 by the buyer. We found out Landsel title decide to ignore the terms and charged the sellers which is us, 100% of the title insurance policy. This is a clear violation/breach of the fiduciary duty Landsel title has with us the sellers, negligence, misrepresentations and a conspiracy because they knew well in advanced the title insurance were to be paid 50% by each side but they still decided to charge us 100% of the policy.

      I am rejecting this response because: 

      Good afternoon.
      A lot of incorrect information.
      1. **** ***** is not my realtor; he represents the buyers and we are the sellers.
      2. The documents clearly speaks on its face, purchase agreements clearly states:
      " Title exam and ONE HALF THE COST OF INSURING PREMIUM FOR OWNERS FEE POLICY OF TITLE INSURANCE" you sending the closing statements as a way to waive any kind of responsibility is again violation of fiduciary duty or was this some type of insider/conspiracy plan to purposely make us pay 100% of the policy and ignoring all of the purchase agreements terms that YOU use to generate the closing statements?
      3. North closing statement signed by me mentions " due to seller" $187,543.92 but your wire transfer was only for $180,694.61....  More than 6k missing

      What are all these irregularities?

      As previously stated in my emails regarding this complaint, ****** ****** agreed to all these fees over 2 years ago when he signed the settlement statement regarding the fees and tax prorations as well as the contract addendum instructing us to give a seller credit signed by ****** ****** and acknowledged via email.  

      For further communication Mr. ****** is free to reach out to our underwriter to file a claim and they will make a determination.  ********* ********* ***** (*****************************.)

      I am rejecting this response because: 

      ***** it sounds like you definitely decide what to consider and what not to because your answers are again ignoring all the issues that are supported here:

      Which is the total negligence of your title company, misrepresentations, breach of fiduciary duty, lack of professionalism and responsibility, potential fraud of making me sign in front of a notary one closing statement with some numbers and then magically producing a different one which was never signed by me, ignoring purchase agreement instructions and more and more,  you potentially have an excuse for each of the points mentioned here since you accommodate your responses the way it works for you but at the same time contradicts overlaps defenses you have for other points 

      For example:

      "to all these fees over 2 years ago when he signed the settlement statement regarding the fees and tax prorations" - NO  i did not signed the settlement statement with the numbers you wired money to us.

      The one that has to contact your underwriter is you since you are the one that intentionally is conducting this type of business practices.

      We will be contacting 

      - Ohio attorney general to file a complaint.

      - Ohio department of insurance.

      - Any government institution that regulates title companies etc 

      - BBB has this business as accredited which doesn't fall with the code of conduct businesses needs to adhere

      Landsel title is NOT transparent

      Landel title doesn't Honor promises

      Landsel title has zero integrity

      We will potentially talk to BBB to initiate the cancelation of this accreditation.

      We have dealt with many companies, from small to big and i am extremely surprised how you ***** the owner of the title company, lacks so much responsibility and total business professionalism for such a small amount of money, never seen this when companies just apologize and actually settles the issues, but wow here even though you know all the mistakes committed by your agency, the lack of professionalism, to accept responsibility is astonishing to say the least. SHAME ON YOU

      I WAS ASK TO LET THEM HOLD 5000 IN CASE WE HAD TO GO TO COURT TO PAY ATTY FEES AND EVICTION NOTICE.

      I SAID NO AND **** SAID IT PROTECTS THE BUYER IN CASE WE HAVE TO GO TO COURT.

      i SAID IT DOESNT COST 5000 TO DO THT

      HE SAID IF WE HAVE TO AND ANYTHING LEFT THE FUNDS WILL COME BACK TO YOU.

      HE NEVER SAID ONE THING TO ME ABOUT HIM BEING OUT IN 30 DAYS.

      IT SHOULD HAVE BEEN MENTIONED TO ME

      WHEN I LEFT I TEXTED **** IF I NEED TO CONATCT ***** (the tenant) I WAS TOLD NO HE WOULD CONTACT HIM. AND WAS TOLD HE WAS CONTACTED AND HE WOULD BE THERE UNTIL JUNE. I GO TO TURN IN KEY WAS TOLD BY SECRETARY TO HOLD KEY AND **** WOULD NOT SEE ME . TOLD SECRETARY TO TELL ME HE WAS LEAVING OFFICE. THEN WHEN I TEXTED HE SAID YOU SIGNED AGREEMENT TENANT BE OUT IN 30 DAYS. I SAID THAT WASNT OUR DISCUSSION. I CALLED MR TURNER AND **** AND THEY SAID THEY WERE TRYING TO GET MY MONEY BACK TO ME.

      I CALLED *******, VICE PRESIDENT, AND HE SAID IF **** SAYS GIVE BACK I WILL, IF NOT LET THE JUDGE DECIDE. I LET **** AND CJ KNOW WHAT HE SAID ON CONFERENCE CALL. AND HE SAID HE WOULD CONTACT HIM. THEY ARE SAYING SOMEONE NAMED JUSTIN BUT THEY HAVE NO LAST NAME OR CONTACT NUMBER FOR HIM.

      I CAN FORWARD ALL TEXTS BETWEEN CJ TURNER AND **** THAT SAID IM SUPPOSED TO GET MY MONEY BACK AND THEY WERE WORKING ON IT.

      ITS 20 PAGES OR MORE

      DONT KNOW IF SYSTEM CAN TAKE ALL OF INFORMATION.

      THEY SAID FILE REPORT ON BBB ON ****** WHICH ADDRESS IS A FALSE ADDRESS IN *********** IL .

      IT GOES TO A VACANT HOUSE FOR SALE.

      I FEEL I HAVE BEEN SCAMMED

      Thank you for bringing this to our attention. It is our understanding that the tenant did not vacate the property on time, and was three days late moving out. Ms. ******* did not provide the text messages she said she had showing Closing Columbus agreed to let the tenant move out later. 

      In any case, if Closing Columbus has agreed that we can release the escrow money to her, we will need a mutual release signed by both parties.

      I SENT YOU THE SIGNED FORM  YESTERDAY AND LANDSEL HAS IT. I GOT EMAIL FROM LANSEL THE FUNDS ARE MAILED OUT TODAY FROM **** **********. WILL RECEIVE MONDAY, IT OVERNIGHT. I SENT DOCUMENTS AGAIN
