      On September 7, 2021 we entered into a contract with Williams Landscaping and Pavers. The contract was for a inground pool, hot tub, cement patio, pavilion, landscaping, fence, and stone veneer. Total cost approximately $200k. They broke ground on the pool 12/20/21. Everything was running smoothly until the spring of 2022 when the work abruptly stopped. The pool subcontractor that Williams hired (APEX 1 Pools) notified me payments from Williams had stopped and he could not continue. After months of chasing around Brian (owner) for answers, we received an email on 8/4/22. The email stated he was having financial problems and he asked us to continue paying to the pool contractor directly along with granting him an extension to the end of October to finish. We agreed to do this to prevent any more delays. Needless to say, the end of October came and went with no work being completed except the pool work we were paying for directly. In November, Brian once again asked for an extension. This time until Memorial Day 2023.... After speaking with him today, we were notified that his business is in serious financial trouble and he has no real plan to complete the work. He also has a new partner but is unwilling to meet with us or disclose who the partner is. We have paid over $187k for a project that is about 20% complete and are begging for him to make this right. Please help!

      We hired Williams Landscaping in the summer of 2021 to build a pavilion in our backyard and paid a large deposit. Completion date for this project was fall of 2021. The project has still not been completed as of Nov 2022. The owner and project manager are no longer communicating with us. We have paid a significant amount of money with very little to show for it. We have been lied to repeatedly about why there are so many delays. After they didn't even start the project by the original completion date, we were promised it would be done by winter. Then we were promised we were the first job they would do in the Spring. When they finally poured the concrete, they asked for more money to complete the rest of the job. The concrete job was so bad they had to tear everything out and start over. They have left our yard a complete mess the whole summer and fall. Now, we are stuck with the mess through winter because as of now, there is no plan for them to come back to finish. We are currently trying to find another company to finish the job, but we found out that everything they did (outside of the main structure that was built by two Amish men) has to be taken out and redone correctly. The little bit of stone work they have done is falling off already. I have two different contracts I can provide to show more details as well as countless conversations via text showing their deceitfulness. They are taking deposits for new jobs they know they cannot finish, and totally disregarding the work they promised a year and a half ago.

      Williams Landscaping like many companies have been affected by the labor shortages and the economy.  While we plan on completing this project, and I would agree that it has been an acceptable time frame, we have not taken on anymore projects and don't plan to until all our past projects are completed.  These are very unfortunate events and completely understand the clients dissatisfaction.  We have wrote letters and have met with the client many time however we have continued to receive messages that are degrading, filled with profanities, and will not respond any more to these types of messages.  We can only continue to move forward and hope the clients will continue to work through these unprecedented times.  We have been in business for several years and have this unfortunate year of hardship that has caused many clients projects to be postponed.  I hope my clients will continue to work with us so that we do not have any more potential damaging events to our company.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID 18461122, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      There was no offer made to resolve my complaint. This business is blaming labor shortages for breaking not just one, but two different contracts with expected completion dates. While the company claims to understand our "dissatisfaction", the owner is offering no solutions other than hoping we will continue to "move forward" and "work through" this issue. I simply cannot trust this company to finish this project as promised after we have already been waiting over a year after the original completion date. They want us to "continue to work with"  them "so that they  do not have any more potential damaging events to our company."  He is more worried about us complaining and causing damage to his company than actually making a serious effort to get this job done.  We have paid over $43,000 for just the pavilion frame and poorly poured concrete. There is still a huge amount of work that needs to be built and finished. If they cannot refund the money for the work they haven't completed yet, then completing this job should be a priority. We have been extremely patient in waiting for any type of completion date, but nothing has been provided still to this day. [To assist us in bringing this matter to a close, we would like to know your view on the matter.]"

      We signed a contract on 7/30/2021 with Williams Landscaping for 2 retaining walls, dry creek bed and drainage and paid a $10,348.56 deposit. We were told the expected start date would be October 2021. Then on 9/14/2021 we signed a second contract for a paver patio, seat wall/fire pit because we were told it would be more cost effective to do everything at once, and we paid another deposit of $12,514.98. On 11/9/2021 we were told the second installment was due for both contracts as they were going to deliver materials and get started. We then paid $16,902.64 and $20,441.51 for both contracts. They delivered materials about a week later for the retaining walls only (25 large pallets). They showed up 12/21/2021 to dig a trench and that was it. From then until June 2022 they had not done any work on our projects (10.5 months). We had gone back and forth through text saying they would be out at various time but never showed for one reason or another. Finally, I emailed Brian Williams (owner) on 6/10/2022 explaining that we had paid a total of $60,207.69 as of 11/9/2021 and nothing had been done for our projects, and we had 25 pallets of materials sitting in our yard for 7.5 months and it had been 10.5 months since we signed the initial contract. He assured someone would be out the following week to start. His crew came out on June 16-17 to start the retaining walls which were going to be 3-4 feet tall. After they left on 6/17/2021, I went out to inspect the progress and was horrified. I immediately took pictures and sent them to Brian, stating that this retaining wall had to come down. It was crooked and not level and he agreed. A new crew came out on Monday to start tearing it down and to start over. After about a month and still not having them complete anything (they would show up one day, then not come for a week or two later) we asked that the job be stopped as we had seen enough. We met with Brian Williams on 7/29/2022 (one full year after the initial contract was signed) and he tried to negotiate continuing the projects, but we requested our money back. He said he does not have our money anymore even though not one single item completed per the contracts after one year. He disclosed that we were not the only customers of his that were currently having issues.

      We have had communication in regards to this matter.  I am not sure if this was posted before or after, but last we spoke the client wanted to return the materials which we agreed was acceptable.  There was also other talks about work that was a different scope but potentially away to resolve this matter.

      RECEIVED VIA EMAIL BY BBB STAFF MEMBER:

      You can see the caulking they put at the top of the frame because they cut into the ceiling and you can see the picture of the shavings of the ceiling…also the top of mirror bows out on each side and there is gapping because the mirror was not made correctly…they just forced this mirror into place by cutting the ceiling trying to make it fit…as you can see there is also bowing and gapping because it was incorrectly made and installed

      Contracted for pavers on existing patio in October 2021. Work started in April 2022. Gave deposit as requested. They started the work - took several weeks (shouldn’t have taken that long..but not the issue). **** up my yard. Never fixed yard as promised -only threw down grass seed. They were to come back and put more poly sand in the cracks that needed it. Never showed up as promised to reseed and fix issues. Still waiting - a month later. Again, I have texts. Now, I get a threading call from ****, very rude, about paying. Then, an email threatening to charge me 12% interest and put a lien on my house if I don’t pay within a week. I think the owner, Brian, needs to come to my house and see the issues for himself. They should reimburse me for what it cost me to fix their sloppiness around the patio, but that will never happen. Photos attached are of the area they claim to have “competed”. The photos with green ground cover is after I redid and corrected their mess.

      The start date of the project was started when planned, and all items completed on contract are fulfilled.  Client wanted sod installed after we repaired lawn with seed, fertilizer, and straw.  The lawn repair is not in the contract nor is anything about sod.  We would be happy to install sod once the project is paid in full and she accepts the new contract for sod.  A complaint shouldn't be issued about Williams Landscaping trying to collect on a completed project, and charges will apply if she continues with complaint for sure.

      Ok So the pavers are a different story.  We were under the impression that the complaint was about the grass and grading.  We don't guarantee grass because it up to the owner the water.  The pavers however will be looked at.  I will have someone out next week.

      On 6/30/2021, I paid William's Landscaping $14038.36 as a deposit for a landscaping job that included driveway expansion, a fire pit, a gazebo install, and pavers. When we met to finalize plans for the project, we paid an additional $4354.36 on 07/07/2021. I've paid a total of $18392.72 for a promised start date of September 2021. After many text messages and emails, the company has not started the project or provided me with a final quote. I have evidence of all of my correspondence and attempts to schedule with this company. The company tried to rectify the situation through the owner, Mr. ***** ********. Mr. ******** came to our home and indicated we would get a final quote and be on the schedule. After that visit, we never received a final quote. We then proceeded to ask for a refund. After more correspondence and back and forth, Mr. ******** emailed on April 12th with the following message: "will be sending in correspondences in regards to your project in the mail. It will be detailed and have the exceptions of both parties listed. In the meantime please feel free to contact me anytime." We have not received anything in the mail as of April 30,2022. Please help us to rectify this situation and get reimbursement of $18392,72. Thank you for your consideration. Josh and Gordana Dimacchia

      This will be an on going matter with our lawyer.  The client had signed a contract and made a deposit for the project which we were ready to start in April as agreed with the client.  Approximately 2 weeks before starting the client cancelled the project.  I am willing to work with the client in cancelling the project, and a letter was sent to them in regards to that process.  Our contract specifically state that deposits are non refundable.  We require this because of our time and cost invested to managing the project.  In the cancellation process we are also requiring a non discloser agreement. I would request that the client would cease any complaints and negative reviews at this time as we work through a settlement.

      I am not sure that you did not receive the letter and this is the first time I have heard about it.  I will reach out to my attorney so they will send it out.  I do wish to resolve this and hope we can come to an agreement.

      The consumer has informed the BBB that she disputed the payments with her credit card company. At least one of the disputes was ruled in her favor and a she was refunded $10,000. The consumer is still seeking the remaining monies paid to the business.
