      I was never told before I signed my membership that I was in a 3 year contract and they won't let you cancel and they keep charging my credit card every month I got a hold on someone last month and they said if I want to cancel I owe $1,400 now and a month later I lost my job and going back to college and I called them and there voice-mail is full I just want to cancel and be done with everybody fitness why is there contracts for gyms doesn't make sense and the equipment is old

      *** ******** was told that he was entering into a 36 month agreement. He even signed our acknowledgement sheet, which I have attached for you. The acknowledgement sheet states that he received 2 copies of his membership agreement and understands the membership is a 36 month term. At this time there is no option to cancel his agreement at will.

      August 5-2023- September 18-2023 $55 and $30 I have contacted their financial department multiple times through phone and left voicemails and multiple times through emails and sent them photos of my new mailing address of proof that I live more than 25 Miles away to cancel my membership and I have not received any responses. They continue to charge my account and will not do anything to resolve the issue.

      On 8/26/2023 I went into everybody fitness after visiting their website. I asked to see the facility and was told i would need a background check done to have a tour of the facility. The person behind the counter told me it would cost me 20$ for the background check and that i needed to give information. I gave my name, age, and phone number. They also asked for a picture so i could be in their system. They requested that i authorize the background check with my signature, that i was giving my permission, and then said that i needed to give my initials to confirm that i was asking for a tour of the facility. I was given 2 weeks to give them 20 dollars and even given a souvenir keycard and a receipt of my background check purchase would be emailed to me within a few days. When ii got the money to pay, i was told that i was a member of the gym and that monthly payments would happen around the 21st. I checked my email and found that the background check was actually a gym membership contract. i called to have them dissolve it but the contract disallows me from canceling in person, or over the phone. I was then informed that i could cancel if i pay them 1,200$. I want the contract dissolved, and i do not want to be a member. My member number with everybody fitness is 7231-112593 The website ********************************* No where does it tell you the terms of the contract, or what you are actually signing up for.

      *** ******** complain is not truthful. We do not run background checks on members. He is trying to cancel his membership after the 3 day cancellation period. There is no option to cancel at will.

      In March of 2023, I moved from West Chester, Ohio to Billings, Montana. I contacted the billing company of this franchise and asked to cancel my gym membership because I was moving somewhere that is farther is 25 miles from one of their locations. They said they need to see proof of relocation and offered me five ways to show it (military orders, job offer letter, lease for a place to live, notarized letter, I can't remember the last one). I explained to them that I was moving without a job, and into a family members home, and asked if there was anything else I could do to show proof. They said there was not. So I without complaint, paid the last three months of this contract as I have worked to find multiple ways to show proof of residency. I have had my current job for TWO MONTHS and still didn't reach out to this company yet because I knew I didn't have a second way to prove residency. I also could not get a Montana drivers license because I lack the proof as well. I just recently bought a car here in Billings. The sales papers have my new address, my vehicle insurance has my new address, and its finally enough proof for me to get a Montana license (which is scheduled for next week 8/14). Since I can get a state license with these documents I reached back out to this company asking if I can finally cancel my membership since i have proof from my vehicle insurance, and pay stubs to prove residency. They still said no. I am being forced to stay in a contract until I provide specific proof, which isn't applicable at this time for me. They are refusing to accept these official documents and keeping me locked into a contract that is suppose to have an out. I have been paying for three or four months now, including an annual fee that just came out for a gym I haven't used since February. I was happy to do so when I knew I didn't have official documents of residency but now that I do, that is accepted by the state, I can't help but feel like they are trapping me.

      I have (had) a membership with Everybody Fitness in Huber Heights. I have no issues with the gym or the membership. My complaint is that I did not receive an email or voice message regarding my direct payment not working any longer. I had a debit card compromise. I forgot to send new information to Everybody Fitness. I was not purposely avoiding payment. I got a call from a rude, loud, obnoxious person yelling about me owing $1065.70 and I need to pay it now. I thought it was a joke or scam. He finally said Everybody Fitness and I said it is paid monthly. He said it is not since my debit card problem in March. I asked why no one contacted me. He said they called me 20 times. These days email accounts and phones get constant scammers and solicitors. I get so many worthless emails that it is difficult to find the important ones and have no idea how to fix that. I do not have any letters, emails or voice messages from Everybody Fitness. I called a few times. Finally today I was told that the emails come from rise financial. I would not know who that was and if it went to junk mail I would never see the email. I did search for it and could not find it. I want my membership and to pay my monthly payments. I understand that due to their contract I will not get it. I do not think it is fair that I pay collections when I cannot get the membership. I would have corrected this if I had remembered or received messages from Everybody Fitness. I feel like they do not care about their customers. I feel like their contract and way of handling things is a trap to get our money without us utilizing the membership. I want my membership reinstated and to be treated like I matter.

      She was emailed and called for 90 days before her account went to an external collections company. our billing company, Rise Financial, attempted to contact her daily via phone for 90 days. They called the same phone number that she lists on her BBB complaint. She just chose not answer. She was emailed at the same email she lists on her BBB complaint also. I am attaching a copy of the last email she was sent by Rise Financial before being sent to external collections. Her account is out of our hands now. She will have to work with Internal Credit Systems from now on. Thank you.

      Hello,
      My father has been dying if cancer and passed on Thursday so I did not check my emails while I was with him in the hospital. 

      I believe the person is lying saying there were calls all during that time. If I should get a copy from my phone company of the calls I will. 
      I do not have voicemails from these supposed calls. I may have recieved an email but never saw it if it went to my junk mail. I searched on more than once occasion and never saw an email from Everybody Fitness. Then I was told it was from the finance company. I searched and didn’t find an email from them either. If it was in my junk folder then ir may have been deleted. 
      I never received anything in the mail. I did not know there was an issue with my payment until I received the call from the collector. 
      I do not think it is fair that I am obligated to pay and do not get access to the gym. 
      All I want is to be able use the gym.

      In this current time in the world, everyone receives tons of scam or solicitation phone calls. I do not answer my phone to numbers that I do know because I get so many of these calls. Most people I know do the same thing. When I get a voicemail I call them back. You may have called my phone that many times with an automated caller, which is what the first person I spoke with said. She tols me the calls are sent via an automated calling system. So did your caller leave voicemails??? I did not have voicemails. If I had that many voicemails, I obviously wouldn’t be in the position that I am in with your company. The issue is I was not informed since I never received the emails or any voice messages.

      I joined Ladies Everybody fitness in Huber Heights In December 2021. I have never gone because I was wrong about my ability to use it due to my disabilities. I have called them many times and was told I had to still honor the agreement. They said I could still use the sauna or do light things. Finally I called Rise financial the people who do the financing. First she acted as though she did not believe me and told me to have my doctor fill out their form. Being that My next appointment was in 6 weeks, I had him fill out the form and sent it. In the mean time I was charged for another month, then the yearly $44 dollar charge. I just had a call from them saying that after getting the doctor's form, it takes a month so they will charge me again before they cancel my membership and I will not be refunded anything. This person seemed salacious when she told me. She seemed to enjoy telling me pretty much too bad too sad, still taking more of your money. I am a disabled veteran and was wrong to think I could join. I explained this many times and they simply do not care. I am on a fixed income and have been paying them for 2 years for nothing. This is very wrong and I think this is a scam. They do not care about anything but money. They should not be allowed to to have people join online. They should do business with pride and not try to fleece. I put my life on the line and got injured and disabled in the army for them and they treat me like garbage. And always have the very empty nerve to say "Thanks for your service. This is just wrong. The amount of money taken from me and will continue to take is food off my table.

      Ms. *******'s complaint has been reviewed by management. Her disability form was received by our billing department on 7/14/2023 and verified today 7/18/2023. We are cancelling her membership effective today. Please accept our apologies in the miscommunication by our billing department. They were under the impression that they had to wait 30 days to cancel the membership after the disability form was verified. They have been informed with the correct information. We truly do thank Ms. ******* for her service. Thank you.

      I am rejecting this response because: During the time that they knew I was getting the doctor to fill out the form I was charged several times.  I think I should be credited from the time I received the form via email with Rise financial knowing I was waiting for my appointment for my doctor to fill it out.  I was charged 2 regular fees and one yearly fee.  I am not asking for a refund for the whole 2 years, just how much I was charged after I let them know I was getting the form  filled out .  My doctor wrote that I had been disabled at least since December of 2021.  My doctor sent me to a Veterans body trainer then.  I thought that meant I could join a fitness center.  But the training failed and just made my disability worse.  That is why I never attended Ladies fitness.  I had a spinal cord stimulator inserted in my back very soon after I joined.  I was never trying to be flaky.  I made a very expensive mistake. It caused me hardship but I am sure never cause any harm to Rise financial.   It is an unusual situation.  I felt like the rep thought I was lying, as I am sure she was the same person who called me to tell me they verified my form, she made me feel as though I was somehow "getting over" on them. She repeatedly said that she was just doing her job and dismissed my threat of reporting to the BBB or speaking to my congressman about the treatment of Vets by saying uh huh uh huh.  Yes I became distressed over her dismissal of me  and told her she was acting like and therefore must be an a-hole.  She said thank you and hung up.  I felt very bad thinking I was hung up on and still they were going to take another fee from me!   Had she been more understanding of my issue all of this would not have happened.  I suppose her job is to distress customers, and I am one as you have my money for absolutely nothing.  She saw I asked for a refund on the back of the form and chuckled that Rise does not refund anyone for any reason.  If that is your policy I have many friends who are contemplating joining there and I am sure they would be very interested in the results I get.  People like to know they will be protected and valued.

      When I signed up with everybody fitness, the manager told me that they were going to be adding a sauna to the Kettering location. It's yet to happen & it's been over 3 years! St that time, I also mentioned how I live in the Englewood area, and I was rejoining because of the pool and Spa packages. He NEVER said the Englewood pool/spa was essentially dismantled... He knowingly misled me! I did not enroll in the spa package alone that he offered me because I wanted to have the ability to visit multiple locations without limitations; however, I've only used the Huber Heights women's only facility Spa area, 97% of the time, as I recieve all other amenities at the VA. Well, the service there is at times shoddy and the steam room was permanently shut down, which was a primary reason why I even returned to everybody Fitness. So when my contract was up, I knew that I would not continue-on because I was given false information initially & intentionally misled. Furthermore, I lost the primary amenities that drew me to everybody Fitness ( Huber steam room & Englewood spa) . Again, I was clear about what I wanted from my membership & he knew what he was offering! So I go into my bank account last night, and see that they are now drafting another $45 out of my account! My membership ends in several days. This is SO WRONG! I am requesting this money back! This is sheer robbery to do a customer like this, especially after knowing you were not going to fulfill your end of the commitment when signing them up!

      Regarding the complaint made by ***** *****, she is free to come into any of our facilities during staffed hours and view a copy of our agreement before submitting any information. Also, if she wants to view the agreement online she would need to enter her demographic information such as name, address, email and phone number in the “Join Online” portion of our website, after she enters that information there is an option to view the agreement.

      I signed a contract with this gym around December 2022 or January 2023 at the Fairborn location. I was given a tour around the building, only to later discover I was only taken around the NICER parts of the gym and not the ran down areas of the gym. This gym is in bad shape. Majority of the equipment is in exceptional diminishing shape or doesn't work at all. The cardio machines, specifically the treadmills, maybe 1/3 of them work at all times. Multiple members have complained about this to staff and myself. The tanning beds barely work, the lay down bed's facial tanner is completely busted and broken. Half of the bulbs were out when I used it. I have been denied access (the door will not unlock with key swipe) on multiple instances when I have been at the Fairborn location around 5:30am. This happened 4 times just in a 45 day timeframe. I have video proof of this but was unable to attach. This alone is a breach of contract as this is supposed to be a 24/7 facility besides some holidays that they are closed for which is understanding but the days I was denied access was not on or around holidays. I am now not receiving any communication back at all after trying to email and call. I have left voicemails (First date is unknown and the second was 5/19). I emailed on 3/20, 5/1 and 5/4... and only able to get response on 3/20's email. I am usually not one to complain but this gym is a terrible establishment and will not help with obtaining my goals with it's condition. I would like the ability to cancel my contract effective ASAP with no cost to me since my contract has been breached with denying access and and no one at the desk to assist. Also to exceptional amount of non working equipment. I should not and WILL NOT travel to a farther location from my home when one is down the road from me. I pay 32.12 a MONTH to have access to ALL LOCATIONS 24/7 besides some holidays.

      The complaint has been reviewed by management. In our opinion most of what she states is untrue. There were a couple days that we had problems with the computer that controls the 24 access door. Those problems were fixed immediately. We have thousands of happy members and we do not want members at our gym who are unhappy so we are, as an act of good faith, cancelling her membership.

      I used to reside at *** ******* ****** ** ****** ****. I now reside at **** ********** ***** ** ******* ** *****. Prior to my move I notified the company because they offer free cancellations if you move so far away from their facility. I am now states away from their facility and tried to provide a notarized proof of residency of my whole family and a car insurance bill that has my name and new address on it. Also tried providing proof from USPS. I am caring for an elderly parent who is not mentally able to sign another document outside the one I already provided. Please help me to resolve this issue so that my account can be cancelled free of charge. This is what they advertise to their members and they refuse to honor my situation because it does not look like every body else.
