We recently had a home built with Kenric Fine homes, in which we’ve had a number of issues with. Along with these issues, we’ve also had to wait extended periods of time to get things serviced from defects we’ve pointed out on numerous occasions and still have a decent amount of them not resolved 6 months after moving into the home. The builder has not been very attentive in resolving these issues or providing service outside of a schedule that doesn’t favor his schedule.
Two major concerns we have with our home is that the builder has taken advantage of our inexperience with the home building process and has breached our contract. According to our home build spec list, which explicitly states “….No alterations shall be made therein, except under written order of said Buyer, which shall specify the amount and time to be added to or subtracted from the original contract price and time by reason of such alteration or change. No change will begin until the change order is completed, signed by the Buyer, paid for by the Buyer and accepted by the Builder. All changes must be in writing.”
Our builder has changed two major components of materials within our home, alongside having us into redoing our original contract signed roughly 5 months prior and charging us an additional $30,000 for what was supposed to be a “lumber price” increase. Per our building specs, the exterior sheathing for both first and second floors of the home were supposed to be “7/16” O.S.B”.
Our home builder utilized a Thermo Ply like product, OX-IS, for over 90% of the first and second floors of our home. We are sure this was done as a cost savings to the builder to increase the bottom line due to lumber price increases, however we were charged for a lumber price increase and were not given said products, and also did not agree to this modification under the terms to change materials in our building specs. The builder also neglected to inform us that he had decided to make this change.
