We contacted Randy in the beginning of the year to redo our roof. He said he could fix a lot more such as siding and gutters. March 11, 2022 we gave him a half payment of $5750 and he gave us a date of 2 weeks. From then on every point of contact I had to contact him first and it was always an excuse to push back the date. We are now trying to get a refund and he is refusing to do so. Giving us personal reasons why nothing is getting done. He asked for a month to get our money back. It has been a month and no more contact has been made. We are now preparing a case for court. We have told him we would even settle for $5000 as it states in the contract $500 goes to him if we cancel. At this point we just want it done so we can get our roof fixed for our children.Initial Complaint

We had siding come off our house in the spring of 2021. We went through our insurance company and they approved a claim where we'd get all of our siding replaced. We hired Randy J who at the time was the owner of a company called Clear Mountain Building, Inc. We signed a contract in June, 2021 to have new siding installed, our trim painted and our gutters fixed up and cleaned. We paid him $4750 which was half of the total job which seemed reasonable to me. He told us it would be six weeks for the install. Moving forward, six weeks went by and we didn't hear from *****. I texted him a few times for a status update, and he always responded with an excuse... Mostly that the siding was on backorder. I waited until mid October and texted ***** again. By this time we had water coming into our house where the siding was missing. ***** gave me the name of the company that he ordered the siding from (***** ******** ****** in Loveland) and actually sent someone out to paint the trim (though it didn't get finished) and seal up where the water was coming in. I called ***** ******** ****** and they told me that our siding in fact WAS on backorder, but it was due to come in soon. Our siding finally came in at the end of October. I started texting ***** again to put some pressure on him to get our install done. Again, he always responded to my texts, and said we were one project out, then that project had some problems, so we were pushed back more. Then finally he said it's too cold to hang siding in the winter, so we would have to wait until spring. Spring has come and still nothing. His new excuses are that he's having lots of personal and family issues. Once he gets them straight, he'll get to me. It is now April, 9 months after signing a contract with ***** and paying him. I'm yet to get my siding. I've asked for a refund and he said he WOULD refund me the money. I asked when I'd get my refund and he has now stopped answering my texts. On November the 29th 2019, we signed a contract with CMBS (Clear Mountain Building Solutions). Work began and they were here a week. And the next week, ***** said he had to fire that crew and get a new one. ***** called us and said he would be here then, next week, but was a no show. This went on for MONTHS...he'd say he would be here and not show up. Went on for at least 3 months. Beginning of February, he bought a tub off ****** from *****. It was the wrong tub and too long and ****** said they wouldn't take it back. However, it said on the ad on ****** "no returns" because the tubs come from *****. He was very angry and wanted more money and I refused. I insisted he sell the tub. After all that, they left the demolition under our car port and I had to pay extra money to have it hauled away. (several hundred dollars). So we got a brand new floor, but the toilet leaked and buckled the new floor, the window mirrors and mud work around the doors still need to be finished, there is grout work still needing to be done, the sink and the plumbing still need to be done and the trim work and paint and mud work around the doors remain unfinished. Trim pieces to both entrances need to be put in, as right no it is exposed to the sub floor. After the tub fiasco and him refusing to come back to work, we are left hanging. He's refusing to come back to finish the job, and frankly, we don't want him back either.
