I am writing to initiate an arbitration between myself and my builder. This is my official demand for arbitration. I have sent a written request to Mr. ******* in July to address to issues with the grading and lawn but he never responded to my request. Name and Address of Other Party: **** and ***** ******* (Name is under ***** ******* I believe but all dealings were with **** *******) TRW Supreme Homes Reg it ******* *** *. ************ ********** **. *** *******, **** ***** [email protected] CCC Development ***** ******** ************* Prior business name: Sterling Homes Statement Of Issues To Be Arbitrated: 1. My lot was only partially graded. There was an issue with my lot being in a flood zone. Mr. ******* refused to grade the rest of the lot. I requested that he clear the lot to the fence and he refused. He only cleared the lot where there would not be standing water visible. He left approximately 70 feet of brush uncleared along with 7 dead trees. I had to hire someone to remove 7 dear trees from my lot. I also had to rent a Bobcat to remove the brush. After the first hard rain I vas able to see problem with standing water. 2. Mr. ******* did not pass the inspection for seeding the house. He threw seed on the ground over rocks and construction debris. He did not put straw over the seed and it washed away after the 1st rain. 3. My house is in a flood zone. I am required to carry approximately $1000 a year in flood insurance. This Iot was placed in the flood zone in May of 2021 prior to me signing the construction loan but after I signed to contract to build. Cosler Engineering send Mr. ******* a letter stating he was to inform the homeowner of certain things -I was never notified or aware of these things nor did I know of Cosler Engineering until I pulled data from the Title company. On 6/16/2021 ***** ******* sent me a text message stating I would not need to put fIood insurance on my home. I closed on June 21, 2021. I had to put flood insurance on my home in September for over $800. I had to renew the policy this week for $984. I have to hire Cosler Engineering to do an elevation survey to see if they can remove my home from the flood zone now that it is build. Mr. ******* said it was "no bid deal". I have a copy of her text message. 4. Mr. ******* had my driveway poured at only 2 1/2" in depth and on a day in December that it froze. When I had the additional driveway added, they pulled the dirt away from the current driveway and notified me that I had an issue. I took pictures of the driveway edges. The top of the driveway is stained and discolored where it froze because it was poured in December and covered. 5. Mr. ******* would put the key to the house in the electric box outside the house for the subcontractors. The electricians took the key home and never returned to key. They have a copy of a key to my house. I am a single mother and not comfortable with men having a key house. I requested that Mr. ******* rekey my house and he refused. I had to rekey my house. Statement of Remedies Sought in Arbitration 1. $4000 Regrading KZB Sewer Water and Excavating 2. $ 585.88 Brookville Rental Bobcat Removal 3. $2,500 Seed - Amount paid to Mr. ******* on my construction loan 4. $132.96 Rekeying my house 5. $2,500 (Flood insurance - Cosler Engineering) Potentially more bill is pending right now 6. $10,000 - $15,000 Remove current driveway and replace with new driveway I have receipts for every one of these items as well as pictures and evidence. I have paid for everything so far except for the driveway. There is so much more but this is the big stuff. Thank you,
