Dec 2021 Green oak asked permission to dig through my yard. They had permission to go through my yard to put in a new main for field tile. They would repair any damages to my yard, fence, trees, put down grass seed fix any other damage to my property in the spring of 2022. There would be no cost to me . In April I emailed Green Oak Farm asking them to fix my yard. My husband could not take the riding mower from the backyard to the front since where they dug and left dirt was the only way to go through the yard. They said after planting season. Went back and forth a few times with ***** and gave her my phone number. **** **** never called me. I called **** on 4/27 and he said after planting season. I had trouble hearing him. I said we need our yard repaired now. They can work the fields but can't find a few hours to fix my yard. 5/26 one man came out with a tractor and drove back and forth over the area. He did not remove any debris such as tile, branches and rocks that were either cut from trees or they dug up. The ground was not leveled out, grass seed not planted which the farmer said he would do, the fence not put up. I sent more emails early/mid June which were ignored but finally got a response saying waiting for yard to get drier. We had not had any rain in a week. It has been over 10 without any rain as of Sat. June 25th but they still have not fix my yard. Now I feel this is a game to him and he will never fix my yard. 6/24 husband called and left a long message on ****s phone. I sent another email telling him to do what he said he would do in his contract. Fix my yard and do it right and I will stop contacting you. I want my yard fixed as per our contract both verbal and written. They are to level out the yard, remove the broken tiles and branches, plant grass seed and put the fence back up that they removed. It has been over 6 months since they dug up my yard.Business response

I am rejecting this response because: The contract written by the business says "Green Oak Farm agrees to repair any damage to the yard, FENCE, trees or any other damage to our property in the Spring of 2022." They removed part of the fence along the southeast side of our yard near the house and in the back on the southwest side near a field behind our property. The fence was removed in these areas so they could get their tractor onto our property to dig. It was suppose to be put back up but is still open and not repaired. My husband called **** on 7/9 and **** stated he would try to get back to put the fence up the following week which he did not. My husband called **** on 7/15th and left a message about the fence. We did not get a call back.

Per your request the following is our reply to the case #above.
We did try to get to Tipp City to fix *** *****s yard in a timely fashion but due to unforeseen circumstances in the farming business we were unable to make it in a time that was satisfactory to **** *****. We were able to finally get there to fix the yard and had plans to return to fix the fence. When one of our employees got there to repair the fence it had already been repaired by the ****** and at that time they requested $500.00 for reimbursement for their work. We feel the $500.00 is not an acceptable amount for the little work that needed to be done to repair the fence:

I am rejecting this response because: It is not my fault there were problems getting my yard fixed. They had about 6 months from Dec. to June when they could have fixed it and didn't. We called numerous times and rarely did they return the call when we left a message. I emailed numerous times and all but a few went unanswered, If they had been upfront and explained there were issues and responded to me then I wouldn't be as angry as I am and would have been more understanding. If this business had called early spring and explained there were issues on their side and kept in touch I wouldn't have had to contact the BBB, talk to an attorney and other people. Ignoring calls and emails showed me this business did NOT care about my yard and they got what they wanted.My husband spent 2-3 hours in April or May to level out an area so he could get the riding lawn mower to the front yard from the back to mow. He spent a few hours fixing the fence on July 30th and buying some parts for it. Now we are seeing debris coming up through the dirt that was not picked up and removed but just plowed over and covered with dirt. That is going to take us time to dig it up, remove it, plant more grass seed and fixing it like it should have been done in the beginning.
$500 is not unreasonable for what we have gone through. The contract said work would be done in spring of 2021 and wasn't. Breach of contract and we should be compensated for that. Labor to fix the yard in the spring and again in the future when debris starts coming up through the dirt that was not removed (branches, previous tile that was in the ground, rocks, etc) Compensated for the parts we had to buy to repair fence. We gave them more than enough time to do what they said they would do. Husband waited until July 30th to repair the fence.
