            State of Ohio, ex rel. Dave Yost Ohio Attorney General vs. Evans Landscaping, Inc.

            The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

            On March 12, 2021, the Ohio Attorney General filed a complaint against Evans Landscaping, INC in Hamilton County, Ohio under case number A 2100907. The complaint alleges that Evans Landscaping, INC of illegally open dumping of solid waste and disposal of construction and demolition debris since at least 2014.

            On September 29, 2022, Evan's Landscaping Inc. was ordered to pay a civil penalty of $550,000 and entered into a consent order to correction the violations.

            On August 28, 2023,  the Ohio Attorney General filed a complaint against Evans Landscaping, INC indicating that the business was in contempt of it's consent order. According to the complaint, Evans Landscaping has failed to comply with the consent order by stopping the removal of debris from the Broadwell site location, leaving it lying on the ground. He also has failed to submit the mandatory progress reports. The Ohio Attorney General is seeking additional penalties including a 30-day jail term and supplementary fines.
