    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

    On November 2, 2023, the State of Ohio through the Attorney General, Dave Yost, filed a lawsuit in the Cuyahoga County Common Pleas Court against business owner, Joseph Vega and his companies – CLE Masonry and Ohio City Contractors, which did business using the name Ohio City Masonry.  Mr. Vega and his companies are accused of violating the Consumer Sales Practices Act (“CSPA”), R.C. 1345.01 et seq., its Substantive Rules, O.A.C. 109:4-3-01 et seq., and the Home Solicitation Sales Act(“HSSA”), R.C. 1345.21 etseq.  The lawsuit alleges that Mr. Vega sold masonry services to consumers, accepting deposits, initiating work, demanding additional payments and then failing to complete the projects.  When consumers attempted to contact Vega to check on the status of their projects, he ceased all communication. Some consumers reported that the work performed by Vega was subpar, requiring them to start over.  The lawsuit also maintains that Mr. Vega failed to provide the legally mandated notice of consumers' rights to cancel their contracts.

    We entered into a contract with Ohio City Masonry on June 10, 2023 to have the steps from the house to the patio removed and rebuilt. Additionally, the contract covered removing the paver stone patio, and paver seat wall. The patio was supposed to be redone with stamped concrete and the wall was to be rebuilt with concrete & stone veneer on new concrete footers. After 4 weeks of reschedule dates they finally came out to start work on August 2nd. They asked for a down payment of $4000.00 on June 10th when we approved the contract. On August 3rd while the crew was working, *** **** the owner asked us for an additional $5000.00 saying he hadn’t been paid by his previous job. We gave him the additional $5000.00 in good faith in cash. The crew came out again on August 4th. They have dug a hole for the steps and cleared most of the stone from the patio. They left their equipment an Excavator and Bobcat and have not been back since. We have a deep hole outside our sliding glass door and a pile of dirt where the patio was. The backyard has been seriously torn up from their equipment and the driveway has been cracked in at least 2 places. We have been calling their office for over 2 weeks with no response or call back and the equipment is still sitting in my backyard.

    I cannot recommend this company. As the priest of St. *********************** in *********, I also cannot in good conscience let other people hire them. We received three quotes for a fallen lintel over our brick garage. Ohio City Masonry were not the cheapest, but I liked their office manager. We paid $2000+ deposit and confirmed that they would be out August 10, 2023 to begin work.I called and left several voicemails. I also texted several times. I finally sent a frantic text in mid-September demanding either the work be completed immediately or my deposit returned. After a few "tomorrow" push-offs, they finally arrived and started demo.They arrived without the proper equipment or enough people. They could not complete demo efficiently and dragged it out more than two weeks. They did not bring the proper adapters for their power equipment and rewired our garage to route a line for their equipment without my permission. They ordered the wrong I-Beam replacement and we had to front them 80% of the job cost in order to continue work. They completed this on Oct. 27 and harassed me until I returned early from an out of town work conference in order to hand them a check. They also changed how they wanted their payments to be made, first requesting cash and then when I said no, requesting we change the name on the check to Ohio City Contractors. The young man was using the wrong tool to trim the insulation and said he would be back that evening to finish trimming it with the correct tool. I regret that I paid them then anyway. Only later I discovered they had not fixed the electrical in the garage as they said they had.It is December 1 and they still have not completed the job. They did not finish the trim and they did not fix our electrical, so we have an entire wall of outlets that does not work.
