I hired Eric in February '21 for a house flip job in Canton Ohio. We signed a contract that stipulated the project was to be completed by 5/22/21 to which Eric has violated despite payments. Eric has shown a lack of dedication to the job and to our contractual agreement. He has on several occasions, taken other jobs in between, travelled out of State (with and without notice) and multiple times been absent from the job for no reason thus delaying the job. I have expressed my concerns to him many times but he keeps ignoring them. He would promise a completion date and for no reason not meet up. Sometime in August 2021 my wife and I asked for (yet another) completion date. He promised to finish the job between 8/31 and 9/15. on 9/8 I threatened to file a law suit for this bridge of contract. On 9/10, Eric abandoned the job and has been unreachable ever since. I want him to finish the job properly within 14 days of this request and pay up my additional costs to the project.

      Business response

      10/10/2021

********** contacted me in January of 2021 about renovating his flip house. The project was to start in February and be completed by May because I had other work already on my schedule for the spring and summer. I worked with him to estimate the repairs needed and prepared a written proposal on February 10th. This is the document ********** supplied for you. This is not the final written terms we agreed on. *** ******* was unprepared financially and had to seek other financing. This delayed the project start date by more than a month. I had contacted a roofing contractor for the customer and negotiated a contract to replace the roof as soon as the weather permitted. I advised *** ******* that the roof needed to be replaced first because it was leaking and the interior renovation couldn’t be completed until it was dry. Also the price he was quoted was only good for a limited time and the contractor would soon get busy with other work if he waited to long. *** ******* insisted on starting with the foundation regardless of my objections. The final contract terms were agreed upon on 3/27/21 and I started work on 3/29/21. The foundation work was completed by 4/09/21. By this time as I had feared the roofer was to busy to get him on his schedule. The roof was finally started on 7/27/21 and finished on 8/05/21. By this time I’m working 7days a week to keep up with the work I had scheduled from last year! Between April and August I did as much work as I could while the roof was still leaking. Much of which cost me excessive time ,labor, fuel ect... I had to pay the neighbor to use her water because ********** failed to get the water turned on. I even went as far as to tarp the main area of the roof at my own expense just to move the project forward. I invoiced ********** for the work I had completed to date in August and ********** expressed no concern over the quality of my work or my attention to his project. I then purchased the bulk of the materials to complete the interior renovation and delivered them to the site. The first week in September  he contacted me via text message and stated that he planned on suing me if I didn’t complete his project by 9/15/21. I contacted him to try to resolve the issue but he was unwilling to be reasonable and insisted that I meet with his lawyer and agree to complete the project by the 15th. At that point I pulled off of the job and invoiced him for the outstanding labor and materials he owes me. It seems to me ********** made a bad investment on an old house in a bad neighborhood and now that most of the work is done he wants to recoup his projected losses.

      Customer response

      10/11/2021

I am rejecting this response because: There are a lot of inconsistencies in *** ********* response. Here are the facts: I contacted him via SMS on January 4 but never got a response back until a month later (February 5) and the final

quote was submitted on March 27. Eric began work on March 30 and the first check was made to him on 4/10...so there was no month delay at all. Secondly, I am unaware of any other written terms other than the one I provided. Any other terms must have been fabricated by *** *********

Also, Eric was never present onsite working 7 days a week. I know this because I typically stop by on my way from work and on several occasions, I did not find Eric on the job. This is because of the several other jobs he took during my job unknown to me and without my approval. This caused a big delay in the project. In addition, as soon as Eric told me about needing water, the city was contacted and the water was turned on. Eric never paid or told me any payment made for the water to the neighbors. Otherwise, he would have billed me like every other item he billed me for. I have never owed *** ******** on any payments, including his last request for $10,000. I even went as far as dropping the check in his house to avoid any delays.

*** ******** needs to be held accountable for the breech of contract and all the lost time on this project resulting in him taking on extra jobs which took away his time and attention from the project. Additionally, the time spent traveling out of town further delayed the project. This is why I threatened to sue him if he did not meet with the target date he set to complete the project. By the way, he has moved this target date several times without any reason or constraints.

I've tried to work with him and address any issues asap (water, electricity, pay etc) but his laziness and lack of integrity makes this impossible.

Upon further review, I discovered from his Facebook page that this attitude is very typical of him. Several clients have complained about this behavior; but I didn't pay attention because he was recommended by my Wife's friend. Now I know better- a lazy, untrustworthy and untruthful contractor like him should never be trusted.
