      On approximately Oct. 25 I hired American Construction to redo the roof over my sunroom because it was leaking and ruining ceiling tiles. We agreed on a price of $2375, which included a five year warranty. December 3 I contacted them to let them know that I still had leaking above the sunroom and ruining new ceiling tiles I had put up. He agreed to come out and look at it. He said that there was a two inch gap in the roof that he missed and it should be good now. February 4 I contacted them again to let them know there was still leaking above the sunroom. He said he will be out February 6 to check it out. He never showed up. February 8 I asked when we could do it. He said he had a family emergency and would be back February 9. Still never came to check it out. February 19 I asked if he was going to come and fix it, he said he was in the hospital and didn't have his phone, but said he would be out as soon as he feels better. March 4 I asked if he was going to be able to fix the roof. He said he would be out March 7. So on March 7 I messaged him to let him know that I left the sunroom unlocked in case he needs to get in there. He gave me a thumbs up, indicating he was going to come and fix it......never showed up. Since then I've tried contacting him but he's either ignoring me or blocked my phone number. At this point I don't even want American Construction to fix it, I want American Construction to cover the cost of me having to find somebody else that I can trust to fix the roof that they didn't fix right.

      It is correct that the customer called I went back to look at the issue with the leak. The second time I went back I let the customer know that he had an issue with the perimeter of the roof and not an issue caused by the rubber roof we had installed.  The leak he has now is separate issue and not due to our work or any mistakes we have made. I had told him that he was going to need to have someone else fix the issue anyway since it was a separate issue. The customer has a Fascia issue the gutter guards are not allowing to drain properly and in turn pulling water in under the rubber work we completed. This is why we I told him that he would need to have someone else come fix that problem. The second time we were out to inspect the issue the wife threatened to sue me so at that point I thought it best to let them move forward however they chose. I did try to help with the issue a couple of ways but told them that it probably would not fix the actual issue and they would probably have to hire someone to address the actual issue. The customer needs a complete new roof and I did let them know that.

      I am rejecting this response because:

      American Construction NEVER said anything about any other issues and I have all conversations saved with no mention of any other problems.  After they were done he said everything should be good, and if I have any problems to let him know.  In the above response he states that the second time he came out to correct the job that my wife threatened to sue him. This is a lie, the only contact my wife has had with this man was when the original job was done and she paid him. I also have the conversation saved regarding this second visit, sent by text to him Dec. 3 stating that unless he could be here before 9:30, nobody will be home. He responded with "that's ok".

      As I mentioned before, I have everything saved, including pictures of before and after the job, and of our conversations, there was never a fascia issue discussed.  The roof was leaking in two spots before you "fixed" it, and as of April 4, 2024 I have a total of 12 different spots on my ceiling tiles. I had a different company come out and give me an estimate to correct this job. They told me that whoever did the roof didn't do it right, including the sunlight seal, which they said you didn't flash, all you did was put caulk around it. 

      This company has not helped with this issue at all and has never suggested we hire someone to address the actual issue as he stated. We had the home inspected before purchasing in Sept 2023 by a reputable company and have had a second roofing company out to inspect this job, neither time was needing a new roof mentioned.
