I would not be filing this except that ***** told me today he was going to take me to court for my not paying. See below for reasons withholding payment ($100 for gutter cleaning.) ***** came out and cleaned gutters on 12 April. All went well until the very last step. He and his employee extended the very heavy 30' fiberglass extension ladder to its limit while it was maybe 15 feet from the house. Then they lost control of it and it fell onto my gutter, causing it to be bashed. (When I saw them doing this I had to walk away, as I couldn't watch: the ladder could easily have fallen in the other direction onto the next door house, or onto a nearby electrical line.) Then ***** said there was nothing wrong with the gutter and wanted me to pay him in full for the gutter cleaning. I told him at that time I wanted to have a roofer check and assure that the gutter was still secure and functioning, and he agreed to wait to be paid. But while waiting some weeks for the roofer, I realized that when I go to sell the house, this is going to be an eyesore. Bottom line, he damaged it, he should bear the cost of fixing it. Instead, he got angry and told me he was going to take me to court. He does not acknowledge any responsibilty for the damage.The cost of the gutter cleaning is probably pretty close to the cost of replacing that section of gutter. I am willing to simply call it even at this point. I do not want ***** doing any more work on the house or using his ladder near my house again.
