the date of the letter is 11/3/23. the letter was addressed to my pod - she is not a cosigner on this account. pod means if i die then she would get any funds available on my account. does not mean she is liable for the account. also this account is a fraud account that i have been trying to clear up since july with pnc. they were supposed to close the account in july. i am not or will not be responsible for the charges in the account. ref ******** this needs to be taken off my credit report and hers as well.

We are in receipt of your correspondence concerning a complaint made against National Enterprise Systems ("NES") by ******* *****. We have conducted an investigation with respect to this matter, and we appreciate the opportunity to respond and provide you with our position.
On November 2, 2023, an account was placed by PNC Bank with NES for collections. ******* ***** is listed as the primary borrower and ******** ***** ******* is listed as the co-borrower. NES does not own the account but was attempting to collect the total outstanding balance on behalf of PNC Bank.
On November 10, 2023, Ms. ***** called in and advised NES that Ms. ******* is not a co-borrower but the payable-on-death beneficiary. Ms. ***** also claimed that the account is fraud. NES has placed the account on hold and reported the fraud allegation to PNC on 11/13/2023 for review.
NES does not report to the Credit Bureaus for PNC Bank.
We apologize for the inconvenience and hope this brings this matter to a conclusion.

National Enterprise Systems purchased my debt from my loan provider some time ago. I recently set up automatic payments to begin paying down the debt. I have repeatedly had issues with their payments processing in the early hours of the morning before funds have hit the account resulting in failed payments. In this situation I have to call the company (they have never reached out themselves to follow up on the missed payments) and in this last instance I have encountered an issue where I am totally unable to reach them on the phone to process the payment. The number I have saved (that I have used several times in the past) either just plays a repeating message saying I will be connected to an agent without connecting me, or just plays a message saying my call cannot be completed. When I tried an alternate number listed on the company website I was simply given a message stating that the voicemail box for the number was not set up and the call disconnects. Missing these payments and being unable to contact the company to resolve the issue can/will result in late payment reporting to credit bureaus and will negatively impact my credit scores. All of the calls I have made are during regular business hours to number provided via the company website or email correspondence.

There was an account placed ******** ************ ***, with NES for collections. The original creditor was ******* ******** **** ******** ** ***** *********. NES does not own the account but was attempting to collect the outstanding balance on behalf of ******** ************ ***.

On July 21, 2023, NES agent suggested that the date of payments change from Fridays to Mondays to allow sufficient time for Mr. ******** to deposit his money into his account. Mr. ******** agreed to the new arrangement.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

This is the second complaint I have had to file with the BBB regarding NES. Their phone systems are STILL disconnected and I was unable to call to reschedule an automatic payment due to a late check resulting in a total halt of my payments (I am now three weeks behind) and I am STILL unable to contact the company to resolve this issue as they have not resolved the issue with their phones after my previous complaint. They also have not reached out to follow up since my payments have stopped.

On March 17 2023, I received a letter from National Enterprise Systems. It incorrectly stated I owe a debt of $2,000.00 to PNC Bank. This puts National Enterprise Systems in multiple violations of the Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA). On March 30, 2023, I disputed this debt with a certified mail letter (USPS Tracking # **********************). National Enterprise Systems responded with documents that don’t show I owe a debt. Please see the attached copy of my early warning report showing this account was closed as of 04/04/2022 with a $0 balance. I do not owe a debt with PNC Bank. Violations: 15 U.S. Code § 1692c (a) Communication with the consumer generally - “Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. 15 U.S. Code § 1692b (2) Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not state that such consumer owes any debt. 15 U.S. Code § 1692b (5) Not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. 15 U.S. Code § 1692d (2) - The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. These violations have caused me great harm in being unable to open a new personal or business bank accounts. This is holding back personal and professional growth as I'm unable to get the necessary accounts to grow my personal and business ventures. Please see the attached denial of getting approved for a bank account because of National Enterprise Systems.

I receieved a letter stating I owe over 5K dollars for an outstanding debt. I have never received any calls, other letters etc. I am more than happy to pay any outstanding debts I have. However, this letter was threatening. I sent a letter back in response to NES. However, as of Jan 2, 2023, I still have not received a response. This morning, Jan 2, 2023, I woke up with a hold on my checking account for over 2700 dollars. No notice, nothing. I have been trying to contact NES ( NATIONAL ENTERPRISE SYSTEMS) for over 3 weeks now with no avail. I am more than happy to settle any debt I have with a payment arrangement. I was completely unware of this debt until mid dec 2022 when I have been trying to settle it. Now, I have a huge hold on my account when I am very recently unemployed. My company did layoffs after thanksgiving and I need every cent in my account to pay rent and utilities. I'm not sure how the BBB can help but I wanted to bring this to attention. Having moved recently, I wasn't able to keep track of my payments and only noticed after six months that National Enterprise Systems had been deducting $312 per month for six months from my checking account with *** ****** ****** *****, and I had no idea what it was for. I contacted them via their web site three times, including the account number from my bank statement (**********). After they didn't answer the first two times I got my bank to cancel any further checks to NES (at a fee of $35), hoping that they would then contact me to tell me what I've been paying for. So far nothing. I'd like to get the $1872 back. Thank you!

On September 7, 2021, there was an account placed by **** ** *******, with NES for collections in the name of ****** * *****. NES does not own the account but was attempting to collect the total outstanding balance on behalf of **** ** *******.
On October 28, 2021, NES spoke with Ms. *****'s son, ****** *****, at which time a settlement was agreed upon for $8,162.00 with $1,000.00 to be paid on October 29, 2021, then twenty-two payments of $312.00 from November 2021 through August 2023 and a last payment of $298.00 in September 2023 to complete the settlement. ****** ***** gave NES permission to speak with Ms. ***** at this time so the arrangement could be set up using her checking information. During this call, Ms. *****, agreed to the entire arrangement using her checking information.

So sorry not to have responded sooner -- I got Covid and was out of commission for a couple of weeks.

Anyway, you guys totally helped me achieve my goal of finding out what I was paying for.  This is what I posted on Instagram and Facebook:

"I had such a helpful interaction with the Better Business Bureau. I'd noticed that each month I was paying $300 for...well, I had no idea. I contacted the payee online twice and got an immediate answer saying they'd get back to me, but they didn't. So I stopped payment on the next check in hopes of finding out what I was paying for, but nothing happened for 5 weeks. So I filed a complaint with the BBB, and within a week I got a copy of a letter from the payee to the bureau, including a phone number for more info. I called, found out I had in fact authorized the payments, but the process had gotten fouled up and wouldn't have been rectified if I hadn't pursued it, and best of all, IT WASN'T MY FAULT."

Thanks again.  I'm so glad I thought o contacting the BBB; it was the first time I'd done so. (I'm 76 years old.)

      Sincerely,
      ******* *****
