  We signed a contract with Northern Ohio Pool & Spa on 9/3/2021, at that time we gave Robert and Rosemarie $33,000. This deposit we were told was to order the fiberglass pool shell from Lathem pools and to order the auto cover. We were told at this time that we had to place those orders so far in advance because of shortages due to covid. They cashed that check on 9/8/21 for $33k. The pool per the contract was supposed to be installed end of May beginning of June. At the end of May Rosemarie reached out and told me the 2nd installment of $15,000 was due and that they would be starting next week (1st week in June). That check was cashed for 1,500 on 5/23/22 and then another check for $13,500 on 5/24/22, Both were cashed the same day. Then we were told they would be there on the week of 6/1/22, then it was the next week. We were promised he was going to show up days after days for weeks and he would no call no show us, we would have to track him down to get an update. It was one excuse after another. On 6/14/22 he finally shows up, he rips out my existing concrete, cuts down my fence without my approval and then sends me another invoice for 1,350.00, which I paid. On 6/20/22 again another day he was supposed to show up and doesn't, we reach out to him and he texts us back to say he received an email and they cancelled the pool and that he could give us a liner pool instead. We told him NO we want our money back total of $49,350.00, we want the yard repaired and the concrete replaced and we want out fence fixed that he cut down without our approval. He is now refusing to talk to us or return any of our money. I believe I should also be owed all the interest I have been paying on this loan since Sept 2021. WE gave them that money then to purchase the pool, now 10 months later he is telling us he can't get the pool and hasn't given us our money back.
