Contractor took over a year to tie us into the City sewer system, and then proceeded to bogus appointments to complete the job he did not complete.

      Business response

      05/20/2024

5.20.2024 BBB spoke with *********************. He said he waits 6-8 months after work is completed for ground to level at that time dirt and grass seed are put down.

[If you do not say why you are rejecting the company's response, BBB must close your complaint.]

      Complaint: 21624522

I am rejecting this response because: I was told a month ago he was coming out within 2 weeks.  The ground has settled for over 7 months.

      Regards,

A couple days before the Work was supposed to be completed the lines were marked frantically according to the tenant. Tuesday May 5/03 cancelled due to weather said he would be out Weds for sure in a text 05/04 did not call or text. Called me the morning of the 5th several times while I was driving at 8:41 am, but I was unable until 10am to tell me he was doing the job, I told him I did not expect them to do it that week due to the weather. He had sent me a photo from inside the house via text at 9:05 am. He had Showed up 05/05 to do the job unannounced to the tenant (This is a Rental Property so I was not there and was at work). The job was not completed that day, when he called me he advised they could not complete the work and it had nothing to do with the weather would have to use earth stabalizing equipment to do the job and the weather had nothing to do with it not being completed. He never sent me before and after camera footage and it took me a couple times to schedule him to meet me at the property as his VM was full and he would not return texts or emails. When he finally did meet me he told me he sold the company and fired the crew. He offered to give me my money back and not do the work. He also gave me some information about the lines and rerouting. The flash drive did not have my line footage it was another customer but I taped part of it on my phone due to the problems I had and him not sending me the footage **************************** this is the easiest way to share the information. I originally paid half the $7300 total contract in the amount $3,650.00 by check and it was cashed on 04/28/2022. He told me he stopped 10 feet short of the road and wanted just another somewhere between 1000 and 2000 dollars by phone. I told him I would not pay any more until the job was completed he threatened to sue and said he has got his money before. He was actually over 20 feet short of the job completion when I met him. Should I refer this to the AG.

To whom it may concern, this job has already been halfway completed the homeowner and us have come to an agreement to replace the remaining portion of the sanitary line to the roadway per the original contract. We have been helpful as we can.

I am rejecting this response because: The Job will not be completed in the time frame for this complaint to be closed in the next seven days and not all issues were addressed on the complaint. I will call the BBB tomorrow to review the documentation I have and my specific concerns but I was only able to choose one option for reason to File and my Biggest concern at the time was having the contractor finish the work per the contract. Currently his proposed time said it would not be until the 2nd week of July sent May 31, 2022, 7:13 AM (2 days ago). You have to original work start date in the initial complaint and there is a link that takes you to a video of one of the major issues. I would like The BBB to review the remaining complaint and will call tomorrow as I am off work then but this complaint needs to remain open until it is resolved.

      Business response

      10/10/2022

10.10.2022, BBB spoke to Kody M*****. He said he was current at ****** ****** residence completing work.

      Customer response

      10/10/2022

I still have concerns that have not been addressed by the BBB or the contractor in writing and need clarification.

When they came out today to replace the coupling that was not set properly according to the other contractor who did not understand why he used that fitting when they were the same size pipe
The contractor removed the coupling on the 4 inch pipe and exposed the fitting that was a reducer
The employee said that they pushed the new pipe into the existing pipe creating a sleeve.
Drains and excavation services then told me that they had shoved a smaller pipe through the existing pipe reducing the pipe to 3” (from my understanding) from the four on the drain line. He said there was no need to inform me of this when they were on site initially
Kody informed me as it is new pipe it is replaced where I believe that replace means take out old and put in new. (The contract said replace)
From inside the house at the “Repair” to his previous work has now been reduced to the size he actually used for the “Replacement” under the porch.
The code says that you can not reduce the flow of water per my understanding and drain lines are supposed to be 4” except on private septic, but I am not a plumber and there may be other applicable sections. I would like in writing exactly what areas were replaced with and what size pipe was used.
A written statement from Kody that all of the work meets the code.
No one has addressed the issue that he not only lied about the amount of work that was completed originally, but also showed me a false spot in the yard using his equipment and the true extent of him being short was not actually known until he excavated the yard and we found that he stopped the line right after the cleanout which was 15-20 feet short of where he dug up the yard but did not actually put in pipe
These concerns are compounded by the fact that it has been 4 months since the contract was started and he has tried to have this complaint closed several times. I thought mediation was supposed to be set for some time this week.
I also have received no email responses or updates from Kody regarding scheduling with the tenant or addressing my concerns. He assured me he sent emails but could not show them to me on his ipad and said that he did not have access to them on his phone. I did have him send me his copy of the initial contract from his phone today to my email while I was on site.and he had my email address in his phone.
He was supposed to email me pictures today and said he did already( never received) he said he would text those were not received. I have some photos and videos taken from outside the hole but I had his employee take better ones up close as Kody had promised photos would be provided as I was not sure if my scheduled availability would meet up with the tenants and I have had to meet him on site on a half dozen issues that arose that were mentioned in previous documentation in this complaint.
These issues need addressed pleas provide me the proper person to do so. Under no circumstances should this BBB complaint be closed without there being a permanent negative rating with the BBB. This is for the benefit of consumers and from my understanding what the department is supposed to do.
