Metropolitan Coatings, LLC (Contractor) and I entered into an agreement concerning a painting project. Contractor provided a warranty which states: "Contractor will correct any unsatisfactory work or defective materials and will repair or replace them for a period of one year from the acceptance of this project..." I paid contractor a contract price in excess of $10,000.00. On the final payment check, I included reference to the warranty in the memo line of the check. When I gave the check to contractor on October 10, 2019, I once again emphasized that a main reason I had chosen contractor for the painting project was his assurances that he would correct unsatisfactory work within the one year warranty period. Contractor was provided written notice of unsatisfactory work and the need for touch ups within the warranty period including text messages, emails (exhibits 2,3 and 4) and letter (exhibit 5). Of importance, contractor me with me and inspected the painting project on September 11, 2020 (again, well within the warranty period) and acknowledged the touch ups which needed to be completed (there was an issue with staining which was discussed but which ultimately resolved on its own and is not an issue for this complaint). On September 11, 2020 and for months thereafter, contractor provided the same verbal assurance -- "I'll take care of it." (Exhibit 6 -- which contains an April 8, 2021 email ad my written notation of a phone call with contractor on April 20, 2021 and Exhibit 7 and 8). Contractor's pattern of articulating that he would "take car of" the unsatisfactory work appears to have been a calculated delay tactic in the hopes that he could try to argue that too much time had elapsed (even if the time delay was solely his doing). Contractor has a contractual obligation to correct the unsatisfactory work. Of interest is contractor's website which states that "warranties are available" (Exhibit 9).
