      I paid a $2,500 deposit for exterior power wash, repair of damaged asbestos tiles and exterior paint. I let the guy know I will no longer be doing the exterior paint given limited funding. He used 2/9 packs of asbestos tiles I bought. I told him I was not satisfied with his work and he told me its my problem and to sue him in court. He went on further to insult, deflect, shame, and ridicule me for holding him accountable. His customer service is disgraceful and I want him to either finish the job or refund me for his work.

      So to begin I never received $2,500 for this job. The customer hired me through a 3rd party who I believe is his project manager. The once I gave my price the project ($5,500) the manager added $1,000 to give to him self (which took the total to $6,500).  So when the $2,500 deposit was given to the project manager, he then brought me $1,500 which is all I ever received for the job. His project manager drew up the invoice, I never drew up anything nor did I sign anything. We came to this property 5 different times to start the project but because various reasons we couldn't start all 5 times. One time the building had no electricity, another time the building had no water, another time the spigot was broken so still couldn't get water, another time the city had put a stop work order on the building because the owner tried to get around pulling the necessary permits for him to get work done around the property. So after several months of delays that were not on our end he informed me that now he does not have the money to go forward with the complete project. I told the customer we would do a amount of work that was adequately worth the money we had received with taking in consideration how much of our time was wasted because of his negligence. So we power washed the building and replaced a couple boxes of tiles. With everything considered I feel that the labor we did do on top of our time being wasted several times was well worth the $1,500 that my company received. When the customer said he was still was not satisfied I informed him that the only thing to do would be to take legal action and I would gladly explain my end in court and have already prepared a counter suit. I tried to be reasonable with the customer but it became obvious that he just wanted some money back because he had dug himself into a financial hole with this property, not because he received less labor then what he actually paid for. The project manager did agree

      I am rejecting this response because:

       

      1) The vendor agreed to perform a) power wash, b) fix/replace damaged asbestos tile. That said, we amended our initial agreement. He only visited the property for this particular amendment 2 times. He says he seen the property upwards of 7 times but that was because he made bids on different parts of the renovation. That said, he wasnt adequately representing the specified, amended work we agreed too; which again only required him to visit the property twice. 

      2) Per the pictures Ive provided, he didnt fix most of the damaged/broken asbestos siding per our agreement. He only replaced 5 tiles. He barely used 1/6 packs of asbestos siding he instructed me to buy. He was supposed to fix all broken and damaged asbestos tile on the front, both sides and rear of the property. 

      3) He told me in a text that he suspected I wouldnt be satisfied and that given I paid him a deposit; ill have to take him to court to get back what is owed to me. He's a con artist and a disgraceful scammer. As soon as I paid him he scheduled work to be done months later (in an attempt to prove he does what he wants on his terms). This is beyond business. This is a horrible human being who treats business as a means to manifest his unresolved traumas on customers. I paid for a service, give me what I paid for, otherwise go seek therapy. If hes done this to me, hes done this too lots of clients. Ultimately,  he needs to be audited, put out of business and see a therapist for psychological trauma.

      I hope you're doing well. Per the images you can see my complaint, the invoice and additional pictures of me disputing this and his horribly unprofessional responses. Ultimately, his goal is to defer and shift blame as much as possible to avoid liability for the lack of work he performed.
