      I paid $260.00 deposit via ***** for interior painting on 9/28/2023 that was to be performed the week of 11/13/2023 On 12/2/2023 I contacted Amy S******* (office manager/owner ?) via text inquiring about the possibility of starting earlier as my rooms to be painted might be available earlier than anticipated. Amy indicated yes and how soon. I responded and indicated there is additional work to be added so would the owner Chris C** want to take a look. There was no response from Amy. The next day 11/3/2023 I sent a text informing Amy that unfortunately my rooms are not ready after all and I apologized. I did ask again for an updated quote regarding the additional work. No response. On Monday, 11/6/2023 I left a voice mail at the office of MC Painting asking for someone to return my call that day. I needed confirmation that our original start date was set and once again requested a new quote. I had a hard deadline for the work to be completed. No response from anyone at MC Painting. I was left with no choice but find another painting contractor who could take and complete my job. I could not keep waiting for someone to respond from MC Painting. After my message to Amy about finding another contractor she had a lot of excuses, etc. I have requested my deposit refund 2 times with to reply. I would appreciate your assistance with this.

      Enclosed is a copy of the signed contract and agreement of terms and conditions. The deposit is a non-refundable deposit. Mrs. ********** has outlined a time frame that wasn’t entirely accurate. The only email received was on November 6, 2023 asking for a refund. I have a phone service that records and catalogues any phone call into my office and message. None were received. We have enclosed the screenshot for the text messages received from Mrs. **********. There were no “excuses” from Amy during the telephone conversation. Amy said “the only message I have received is the above text”. During Amy’s telephone conversation, Mrs. ********** revealed she has a lower price to perform the work. We believe this was the driving factor in her breach of contract. Also, she hired another painting company within 4 days of Amy asking her “when would be a good time for you”. Amy received no response.  Mrs. ********** claimed a hard deadline, we had this job scheduled to start on 11/14/23 since 9/27/23. The foreman was given the work order on 10/17/23 in preparation of the 11/14/23 hard start date. At this time, we are requesting liquidated damages in the amount of an additional $1000 for expectation profits and overhead calculated in the contract. The deposit is non-refundable.

      I have attached screen shots of my text message conversation with Amy S*******,  one specific message states all her excuses as to why she could not respond.  I have also included a screen shot of the date and time of my voice mail to MC Painting along with a screenshot of my email to MC Painting which finally got a response.  Amy S******* never called me and I most certainly never told her I found a better price.  In fact I ended up paying a slightly higher price to get my project completed by my deadline. I would have included a receipt of this but I had maxed out my number of attachments allowed. I will send it if requested. In closing,  I  needed confirmation of my painting start date and could not keep waiting for anyone to respond.  This is just really poor business practices

      I have a complaint against MC painting . I have attached contract emails and pictures to back up my complaint. They have put a lien against my home which I would like to have removed so I can get another company to fix my home which is going to cost me over $6000. The lien is attached which is was emailed to me, from what I have read it said it should have been sent to me by certified mail, sheriff or in person so I even wonder if it can be upheld. I have had problems with this company since day 1 with their lack of communication with me and I believe out right lied when they told me R****** was an employee he could not read the contract thought all he had to do was replace a couple of piece of T -111 on the fire place paint them white same color I had and paint the trim the same color it was one coat there was not his interpreter and chris or a Superintendent t help with the situation and he wanted me to pay him the remainder of the $6370 after that little bit of work was done so I had to deal with explaining to him what was on the contract so it makes me wonder what else they lied about.

      Overview

      The contract with Ms. ****** was to paint and install carpentry. As per the contract, the house was painted. The T-111 was not cut correctly on 2 sheets (one in back and one on chimney) and the 45's on wood trim were not done. The contract states to piece in wood trim. Ms. ****** did not like that look after completion. She also requested carpentry in front to be installed. She was not charged for these changes. After meeting with Ms. ******, a touchup list was created.

      The warranty foreman, David, was given the list and wood repair to do on the house. He did not perform the T-111 repair because he was unsure of the installation at that time per the work order as written. Once David notified me of the situation, I met with him at the jobsite. Ms. ****** was not present but notified me that her camera saw us on the property. She stopped any remedy to cure and threatened police involvement if we were on the property. To close the contract, I offered a settlement of $4670. She rejected this proposal and offered $2000. $2000 was rejected and a lien was placed for $6370. Due to the inability to cure areas, time and monies spent on this project, the removal of the lien cost will be $6000.

      The house was painted and my gutters, soffits, concrete, I have white paint on the blue paint and blue paint on my white paint, I have paint already peeling off, there is white paint showing through the blue paint, and I have two colors of white paint on my trim because they did not have any records of the color of white paint that was used by the first guy since he was a contractor and not an employee like I was told, and they did not even prime the wood they installed so know it is turning black and rotten the wood they put up, so all of that wood now needs to be replaced at a cost of $6,000.  They did not caulk wood on wood which it states in the CONTRACT so now water is getting behind the wood and again rotting the wood new and old.
      Again, the workmanship was shotty he hired people of the street with no experience from what I can tell and other people who have looked at my house agree, for someone to piece in a section of trim approximately 3x3 in two places in the front of the house, instead of using the proper size of trim they would cut and piece pieces of wood like 2-3 ft long to make it work…I provided pictures of how bad my house looks.  The work was far from being professional workmanship and they should not be doing business for the public.  In our original conversation (Chris) they were to replace all the rotten wood on my house I did not make any changes except after seeing the workmanship they were doing I did not say anything about them not covering up the air vents with T-111 on two places of my house I left that alone after seeing and dealing with them on everything else.  Also, you do not cut the metal piece that is between two pieces of T-111 so you can fit it in because you did not install it at the beginning of the job and then try to caulk it to make it stay in place again more places for water to get behind the wood and now the caulking is pulling away from the wood and metal.
      I have no idea where he came up with this statement “David was given the list and wood repair to do on the house.  He did not perform the T-111 repair because he was unsure of the installation at that time per the work order as written I met with him at the jobsite”.  This statement is a lie, the second group of guys who stated they did not know what they were supposed to do because the office never gave them the information my husband had to give them my list, so they replaced some of the wood trim and painted again places that were missed from the first group and again got paint on my concrete, blue on white and white on blue.  The last group of guys told me I needed to call the office and let them know they were done, I was at work and had no idea if they were done or not or what it looked like, I emailed MC Painting and told them that is what he told me.  No one contacted me for about a week after the second group than all of a sudden I see people walking around my house, at first I had no idea who it was and then I was able to figure out, it was the last two guys who worked on my house and Chris and not sure who else was there…and yes he did not even contact me to let me know they were coming out I could have had my husband there but again the communication with this company is terrible.  I did tell them to get off of my property because they had no right to be there, and I had not idea what they were going to do to my house…I did not want them to try a 3rd time since the could not do it correctly the first 2 times they tried.
      The work if not worth $6,000 because I have to pay another Company to fix their mess and it will cost me $6,000 to have them fix the mess that MC Painting has created and I am sure once they start replacing the rotten wood from what MC Painting did it is going to cost me more.

      You are paying $6340 to paint and replace the woodwork per the contract. The additional woodwork would be an additional cost. The contract is clear from our initial visit. You requested R****** to replace wood in front of the house which was not outlined in the contract after he had caulked and puttied the areas not to be replaced. The issue at hand is: you stopped our legal right to remedy.
      The wood replaced by MC Painting is highly unlikely to be rotted in a year. The deteriorated and rot areas was not caused by MC Painting, but the lack of ordinary care and maintenance of this property.
      As I mentioned before, you have a duty to mitigate any further damage after you made the decision to not allow us to remedy. We will accept a cashiers check for the removal of the mechanics lien in the amount of $5670.

      I still welcome a Representative from BBB to look at my house and see the workmanship of McPainting.
      I resent the comment “lack of maintenance” I have painted my home 5 times myself and wish I had painted it last year.  I also have wood and trim wood on my home that is 15-36 years old, and it is holding up better than what McPainting did last year.
