I had a fire February 2023. I signed an eight month contract with SM in March 2023. They did not complete the job until April 2024. It was a total loss. They said it would be ready by Xmas. Nope! Then they sent me a final bill containing $36k of fraudulent charges. When I complained, they removed some items from the Scope of Work from my insurance company but not all. They said they were checking with the subcontractors on other items and they sent a revised reduced invoice. Keep in mind, they removed the items they billed me for but did not actually do. When I then complained about the additional labor costs and unapproved upgrades, they did not respond. Instead, they filed a lien for the original bill, including all the items they know they did not do. That would be a crime. So now, I’m dealing with their attorney who will not respond to my emails. Wont even acknowledge whether or not he received my debt validation request. Like total silence. Keep away from this company. They filed a false lien in court and now wont respond to me cause they know it. My next step is to show all of NE Ohio how shady this company is. We went weeks without work being done. I had to beg them for the final invoice which took three months and when I complained about the final price, they filed a lien. Said it was to protect their interest. Regardless of their response, I was not the project manager and they knowingly filed a false affidavit! Regardless of what happens, regardless of how long it takes, I am going to show Ohio that dealing with this company will be the worst mistake you ever make!!!

In regards to timeline, we did not state the job would be completed by Christmas. The client was told it would be completed in the month of February by the onsite PM. Delays were caused by the homeowner contracting portions of the job out to other companies.

There were no “fraudulent charges.” We removed items from the scope of work that had been purchased by the client as well as some items that the client had other companies come perform.

The client was informed that we would be placing a lien on his property until the adjuster had released the final payment. This is standard practice in construction when payment is not received in full before lien rights expire. We wait until it is absolutely necessary to file and we release liens as soon as payments are received.

Our scope performed was based on the approved estimate by the client's insurance company. We are unsure of what the client is referring to by "unapproved" additional labor costs and upgrades. We reached out to the client on June 28th to have a meeting to clarify any misunderstandings re: Unapproved upgrades and/or additional labor costs, and the client denied this meeting. We would be happy to meet at the client's convenience to discuss these items further.

You can close this complaint. A resolution has not been reached but apparently you don't understand?

Maybe read my initial complaint? Then read their response. Then read my response. Thought that's how this worked?

After reading this response and browsing some of the other complaints about other companies, you seem to not solve a thing.
