March 17th 2021 order three windows two of the windows were broken. I returned the broken windows on 3/30/21 and ordered 5 windows two were replacements for broken windows. I was told by Richard the salesman at Kerbler that the owner would need to give the credit for the broken windows. September 17, 2021, I was notified the 5 windows were in, I came in and Tom K***** told me no returns on windows. I left without the windows & tried to stop payment on the windows buy my credit card but it was too late to stop payment. I have asked for my 5 windows and credit for the two windows that were broken, they are now saying that I have received these windows. Tom Kerber has not contacted me and was there when I did not pick up the widows due to the no credit given for the broken windows. Attached are the letters and receipts for this transaction please let me know if you need more information.

      Business response

      04/14/2022

We have been trying to resolve this matter with Mr. ********* for some time. Mr. ********* has changed his information several times. Attached is our paperwork/ response that we sent to *** ******* ** ******* *** ****** *** *****
We have asked Mr. ********* for any of his paperwork that would show that we made a mistake. He has not supplied anything to us from his records.
He claims he ordered window glass on his first order (see attachment), our question is why did he take the shelves and pay for them if the order was wrong? The next question is why did he take several months to bring back the cracked glass? Since then Mr. ********* had the glass in his control, anything or person could have caused the damage to the glass. We should not be held liable for the broken glass that he had full control of for months after purchase.

Please read over our correspondence to Mr. ********* .

If you have any questions please feel free to contact us!!

      Thank you,

      Thomas K******

      Customer response

      04/20/2022

In response to the Tom K****** response, I would like to show you that I have not received the windows order on 03-30-21 for $779.39 that was paid for on that date with the recent attach to the invoice.

It was stated on their text message that the charge was paid at time of pickup. That is incorrect it was pad for at time it was ordered.

I will send you the estimate from *** ***** **** ** ******* **** all the widow that need to be replaced on the home which 6 of those windows were order from Kerbler but not received.

I will send notification from my contractor that the first order was received, but 2 of the 3 were broken. The second order was not received of the 5 widows order on 03-30-2021 for total of $779.38.

They are showing an order that I never made, the windows had an order date of 03-08-2021 made prier to my first order. I have no record of this order and no payment on this order.

I would like to see my signature on the invoice when I pickup of both orders that supposedly I pick up, I signed for the first one, but I have never sign for any other order the Kerbler& Co. has said I pick up.

On the bottom of the invoice there are numbers showing the order that they were written. If you would see both orders, I have receipts from are # ****** and 0*****. The recent for their order that in question was made prior to the first two the orders, the numbers are out of sync with that invoice # *******. I feel this was not in line with what is being communicated but the Kerbler company.

When I went in to pick up the order made on 03-30-2021 I brought in the two broken windows and was told that the owner would need to made credit for the damaged windows. When I went into pic up this order, I ask for Ton K*****r the ********* of the Company to give me create for the returned windows as stated on the bottom of the receipts. His response was there is now returns on any widows once you take them out of the store. I did not like the way he was communicating this to me, and I left without taking the 5 windows.

I will send photos of my home showing all the windows that have not been replaced to confirm that the window has not been delivered to me as stated by their response.

      Business response

We answered Mr. *********'s response paragraph by paragraph, labeled 1-8:

      (1)  He did receive them.  How come we have a receipt with his charge card paying for them?

      (2)  On most orders we do not require pre pay.

      (3)  He did not order 6 insulated glass united, only 5.

      (4)  He states in line 2 of 3 were broken yet he ordered 5 units.

      (5)  This order was his 1st order for 3/8" thick glass shelves in which we have the receipt with the credit card receipt.

      (6)  Do to covid, we have not required our customers to sign their credit card receipt (to prevent as much spread of the virus as possible).  We have a copy of his first order (glass shelves) and he did not sign the credit  card receipt.

      (7)  We have 3 sale receipt registers in our shop.  Each one could have different invoice numbers .  We also have several numbering systems for different kinds of orders. Our register sales receipts are not of out sync .   We are at 10,873 (Invoice number) since his last invoice number of *******.  We have made sales of 2935 in 110 days.

      (8)  If Mr. ***** ********* would have brought back to us the broken units in a timely manor and not several months later he may of got us to reorder them.  The insulated glass he did not puck up, we will old on to them, he is not the only one in the city with that window.  Mr. ********* has got his 2 orders and paid for them therefore he does not owe us anything anymore., we will use the order for other windows.
