      Business response

      07/29/2024

Dear Better Business Bureau, we appreciate the opportunity to respond to the customerscomplaint. We will address this complaint with facts and documentation if required for each item.
Unnecessary Delays After the contract was signed in October of 2024 a completion date was scheduled for February of 2024. In October of 2024, the home was out of drywall and ready for painting, as the customer had picked their colors immediately after signing the contract. A few days later, Mr. **** stated that they would like to move into the home in the month of April to early May 2024, based on the fact they were selling their home, and their children were still in school, and changing school districts would put a strain on commuting. Selah Homes granted the request,by pushing scheduled work of its subs out for a month or so after painting was completed. In Mid-December Mr. **** contacted Selah Homes and stated that their home had been sold and they needed to be in the home by late February (the original contract date) and no later than mid-March. Mr. **** was told that because work was slowed to make their April to early May date, it would be impossible for this date of February to Mid-March to be made.
The customer fails to mention the following documented delays: Several changes to the original plan by customer including removing a load bearing column in the kitchen, in which Selahs engineer had to be consulted. Along with the column engineering consultation and recommended changes, the major issue became the electrical run for the entire second floor. The main wiring for the entire second floor ran inside the column from the basement up to the second floor. The electrical had to be re-wired and re-routed, walls removed, sections of ceiling removed and several outlets on the second floor reconfigured. This process took approximately 2 weeks.
Other Changes to original plan: Installed ******* flooring throughout the entire home. The entire 2nd floor upstairs was to be carpeted along with the master-bedroom on the first floor, before the changes by customer. This added an additional week in a half of installation. The customer also added an installed a heated floor for the entire master-bath including the master closet. This required additional wiring and time.

The customer also fails to mention the oversized island that was installed replacing the original island. To reconfigure the island, changed the original install date, and the new install date was pushed back three weeks from its original install date which was early April.

To get the customer into the home, based on the changes and change of closing dates, Selah Homes pursued a temporary occupancy permit, which was granted on May 7th,2024. On June 18th, 2024, a Final Certificate of Occupancy was issued. All items required by the county building department were completed and signed off on.

There were also funds due to Selah Homes held in escrow by customers bank, for items that needed to be completed by June 30th, 2024, those items were completed on June 27th, 2024, three days before the deadline, and an inspection was ordered by customers bank on July 2nd, 2024. The inspection was completed and approved on July 15th, 2024, by customersbank.

Customer Complaints Addressed:  Customer states interior/exterior paint is missing. Exterior door needs to be painted. We are not aware of any other exterior painting required. Currently we are waiting on replacement parts on the door that were damaged during the tornado that hit the area in late April. Interior painting was in the process as of July 24th 2024 when a dispute arose between customer and ********************************************* subcontractor regarding what was new damage to walls and not part of punch list. Selah Homes spoke to both the customer and subcontractor. Subcontractor has agreed to return for punch list items only. Customers also mention broken windows. This is not an accurate statement. Selah homes and Mr.**** identified a hairline crack in the master bedroom transom window after the storm occurred. This is in the process of being corrected as Mrs.**** and the window company have been in contact as recently as of July 25th, 2024. Customer state roof is not complete. This again is not an accurate statement as the roof was completed after the framing of the house prior to the customer signing a contract. The metal roof over the front porch was completed in April of 2024 prior to customers ***************************************************** is aware of the ridge vent piece that was damaged during the storm and is currently working with the roofer to repair this issue. Customer states sheetrock is not complete. This is not an accurate statement all sheet rock that was torn out for changes made by the customer has been repaired. The bath on the first floor still needs trim, sanded and painted. Customer states cabinets in the office are missing. This is not an accurate statement. All cabinets for the entire house have been signed off by the customer and cabinet maker and set by *********************************************. Customer is referring to an end piece called a skin that COVERS the end side of a cabinet. The customer was instructed that, because they and the cabinet company are responsible parties for the cabinets, they would have to contact the cabinet company for this piece, and we will install it when it arrives. The customer states the entry bench not installed. Customer was aware that this was part of the punch list and is scheduled for this Thursday August 1st, 2024. If the date changes the customer will be informed.

Customers Concern regarding lack of communication and a total disregard to them as buyers. Regarding this complaint, Selah Homes was and still is in contact with Mr. ****. Selah Homes has never communicated directly with Mrs. ****. All communications were and is still with Mr. ****. We have documented communications via text messages, emails and response times. In almost all cases 15 minutes to 2hrs has been response times to Mr.****. With over 300 text communications since the signing of the contract, Selah Homes has not disregarded the customer as buyers by any means.

We will continue to work with the customer to complete the remaining items on the punch list as quickly as possible.

      Best Regards,
      Selah Homes, OH. LLC

      Better Business Bureau:

I have reviewed the offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of my decision appear below.

I appreciate the response; however, it does not address the complaint at hand, the work agreed upon is not complete.  Yes, we asked to change items in the house and that's why we offered to pay 50k over asking price which was accepted. In October we asked about removing the columns in the kitchen, we were advised that they were cosmetic and easily removed.  It was not until several weeks later that we learned  of the impact to electricity and plumbing.  This is not on us, we asked and we were assured that it was any easy task.  At this time, we were still being told the house would be complete at the end of February.

To get back to the matter at hand, we want the remaining items complete within a fair timeframe.  Selah Homes has put us in contact with the contractors/vendors whom are responsible for completing the work, they are not responsive and provide false hope.  Just last week the painter was a no show on Monday and Tues.  Wed they were supposed to be here first thing in the morning, again no show until noon when **** the supervisor showed up with a team of about 5 workers....they came in wondered around the house for about 20 mins (while my 10 year old daughter was in her bedroom) and then abruptly left. We reached out, they told us to call the builder....he tells the builder his staff walked out on him....so now what?  Keep in mind, we feel disregarded when folks are no shows, out of courtesy I'm making arrangements and paying for the dog to be gone the entire day so they're not interrupted.

The ********* that was scheduled to be here last week and now on 8/1 told me himself that he is never coming back to this house and will only work for Selah Homes again if he is paid 60% up front.

As for the window company that we were put in touch with, super nice guy but has already said some of this is due to tornado that hit (on March 14th not April)  and most likely will be on the builder.

We can both go on and on and have this be a he/said she said issue , I'm not going down that rabbit hole. We are not asking the builder for anything more then what was agreed upon, just complete the work in a timely manner....that's it.

      Regards,

      *******************************
