      I signed up for the gym. I went to stay with my son in Durant. ******** and I joined the gym with him because he got into a car accident Hi paid a lot of money to sign me and my son up I was not staying in their permanent, I explain to them I live in *******, I had to cancel my membership August 16, 2023 because I needed to go back to ******* and **** to take care of my house. My son canceled his membership. Also I called and spoke to the managers girlfriend and she was talking and I was on the phone and she was asking him what to do. All I needed to do was to cancel. My membership was to show them proof that I was in ******* and I sent a storage bill with my new address on it in *******. They said it was OK to cancel now I keep getting bills ask the bills that I owe money they still didnt cancel. I sent two emails I sent two letters and also they were supposed to give me a gift card for referring a friend. I cant understand why they will not cancel my membership when I was approved for. It seems to me that just trying to get more money. Theyre still trying to take money out of my credit card For the monthly fee its not fair because they agreed that I can cancel August 16 with me and my son Ive called many times Ive sent many emails and still they have these **** Im not sure what it is. Its a company that does their billing I explain to them and they said they can help , they said it was up to the manager once again for them to cancel when I have all my proof I even called the corporate office and I even sent an email to the corporate office that my membership was not canceled yet. Please help me its not fair that they keep taking money out . I have my original letter and I have screenshots of proof that I did call them. Thank you for taking the time. Please let me know. I want this canceled for me and my son, ****, ********.

      ********************************* and her son **** signed up for membership on August 31, 2023. (See first two attachments) They both used the gym into September(image 3).  All of our conversations/interactions with her are documented in image 4.
      Based on the above, she could not have cancelled her agreement on August 16.
      When people sign up they are told our cancellation policy which is also on the agreement.  They have to sign that they understand the cancellation policy. The policy requires them to come in and sign cancellation paper work.  They have to pay any past dues and any dues due with the next 30 days.  They also get to use the gym for those 30 days.  There other option to give us notice is to send a certified letter.
      The attached file shows the letter we received on Dec 13,2023 requesting cancellation. Notice it wasnt sent certified mail.  We are happy to process the cancellations for both of them once they pay their outstanding balances.  Her outstanding balance is $173.86 and his is $231.36.

      I was told this is no contract- MONTH TO MONTH payments $39+ tax for my husbands ***** for mine on top of his.. we both stop going in April, have no contact with anyone all of a sudden in June Im getting calls saying I owe $200+. If I stop going somewhere with no contract it should cancel, but with them it doesnt? *** got SEVERAL people saying the SAME thing happened to ********* got sent to collections. Now theyre saying to be able to cancel I have to pay it all off and sign to cancel?? Soooo I need to break my CONTRACT then right? If thats the case why was I told no contract? I dont expect money back for any reason but I dont expect to pay what charges they have for me when thats not valid & I dont want it sent to collections to ruin my credit over something they did.

      Our cancellation policy was explained when you joined and is part of the agreement that you signed. The agreement does charge month to month and you are not tied down to a set period like a year or six months.  However to cancel you must give us 30 days notice.  Anything past due or due in the cancellation period must be paid and you may use the facility for that time period.  Please note this is very similar to a ******* subscription.  If you stop using it, it is not automatically cancelled.

      We will work with you and remove late fees etc.  I hope this helps clarify the situation for you.

      I am rejecting this response because: that is a lie. Using the word agreement where contract should be and messing everyone over is not good business. Im not the first this has happened to. I was not informed of a 30 day cancellation but I also dont understand why thats even being said if its a month to month basis? I dont have late fees. I have MONTHS of things that I actually COULDNT & DIDNT use. I was told you pay month to month and cancelling is no issue, this is not whats happened. Im more than comfortable paying what I owe, as in the last MONTH for my accounts, but not paying for extra months. And since platforms (like ******** are NO CONTRACT-you actually DONT still get charged if you miss a payment. That is 100% the POINT of going with no contract businesses. Also, I called the business before I rejected this offer and was told there are no late balances just the couple of months memberships and we will not cancel until paid so calling and having is resolved isnt happening I guess.

      This is your second time signing up with us.  You were a member under your previous name of *********************** and you cancelled that account in September of 2021.  Our cancellation policy has not changed.  Notice has always been required for cancellation.  This is spelled out in the agreement that you signed.

      As noted previously, we will work with you regarding late fees and other charges that the billing company may have added to your account.  To cancel, you must pay your outstanding balance net of that amount.

      I want to see papers that I signed (again because its a CONTRACT) because I actually DIDNT go through this when I cancelled the first time OR I wouldnt have came back? So what Im hearing is UNLESS I pay 200 dollars that I wasnt aware of,I cant cancel, which means it will KEEP ADDING money to my account that i CANNOT use, because I cant cancel the CONTRACT, without paying what I obviously cant pay?  So when exactly will this stop ADDING money to my account if I dont pay?

      signed up for services for family plan, my wife and I on Feb 21. Used their facility maybe three times in 3 months. The smell of marijuana became overwhelming, and we could not tolerate it. I inquired about canceling a few months into the service. I was told canceling was easy because they can tell we do not use the facility, that we do not show swipes to get into the door, so my plan could be discounted. I should probably place my account on hold for three months (August) without being charged, and if I came back in and the smell of pot was gone, I could resume service without charges. None of that was true. I was delayed but I should not have had the excessive amount of late charges to my account.I called and tried to speak to a person.They referred me to the manager who didnt return my call. I went to thefacility, and the manager had attitude. Eventually, the amount in question was drafted from my bank, and my wife was told then an additional $60 would need to be paid. baitandswitch

      On January 31st, 2021, Mr. McCarter and his wife signed up for Premium Plus and Premium Plus Add On plans respectively.  On May 10th, 2021, we froze their accounts for 3 months (our normal policy is to freeze one month at a time but they were freezing due to financial hardship and we wanted to help).  When the freeze was over, on August 28th,2021, the automated billing system was not able to process your payments due to insufficient funds.  On September 5th, you came onto the premises at 1:30pm wanting to cancel.  At this point, our front desk staff explained to you our cancellation policy (which was explained when you signed up as well as was sent to you in the email with your agreements).  In order to cancel, you are required to give 30 days notice, pay any amounts past due and pay what is due in the next 30 days (you also get access to the gym for those 30 days). You did not cancel your accounts on September 5th.
      Our billing company was able to pull the amounts owed for August on September 17, 2021.  By then, you had accrued two late fees which increased your total amount due from $61.21 to $103.04.  Throughout all of this time, you were receiving emails and phone calls from us and our billing company regarding your accounts being delinquent. On September 24th at 2pm you came into the gym angry and wanting to cancel.  This time the assistant manager spoke to you about the cancellation process etc.  He has the authority to deal with issues of this nature.  The amount charged that day was what was due in the 30 day notice period which began upon you signing the cancellation paperwork.

      Due to the above, we do not feel that a refund is warranted.
