On 7/29/2021 I rented a one bedroom apt from Dwb llc. On initial inquiry the apt rented for $900.00 once I agreed to move in went to $905.00. The security deposit was $400.00 with a $50.00 application fee, as well as first and last months rent which I wasnt aware of until I paid first months rent. In which landlord agreed I could pay out over 3 months.( it was a rushed process this wasnt initially mentioned or discussed).I am a very clean person thats keeps a tidy home. I was even asked by landlord if he could show my apt to potential tenants. My stove went down it took a month to repair because he said his repair man had Covid. Did not complain was understanding. Jun 11 th sent a picture of black mold. It too until July 13th for this issue to begin to get resolved. Black mold is deadly. The complications from it can be devastating. I was patient and understanding. I have all dates and photos. Upon my moving out I paid for apt to be cleaned. Move out was July 31st. I text him on July 31st about deposit and move out, no response. I texted again on 08/02/2022 asking about my deposit. His response Im not having this conversation, if you do get a refund it will be after I get invoices for patching, painting , cleaning. I have my photos of what I left and their are no patching to be done. I want my deposit for following reasons, over 30 days to fix black mold is unacceptable. Its irresponsible and the apt was left in the same condition I moved in. I deserve either my deposit or 905 months rent for mold. I have written proof and photos sent to dwb. Its very unprofessional to try and keep my deposit after the patience Ive had with all this.Business response

************** was provided with a lease agreement to read and sign well before he moved in. I have a signed copy of his lease and it is dated by him on July 29, 2021. Our discussions prior to signing the lease covered the monthly amount, $905 rent per month and the fact that first and last month's rent was due upon move in. I agreed that ************** could pay out the last month's rent over three months. In addition, note that ************** paid one half a month's rent or $450 in deposit not $400 and was not charged a $50 application fee as it was $35.
With respect to his oven, my repairman tested positive for Covid. I informed ************** and was told that this was not a problem. The repair was made soon after my repairman returned to work and well within the time frame required by ******** Law.
I was notified by ************** that he had a leak that was causing a mold issue. I think it was mildew. The roofing company had already been notified but could not address the issue due to continued rains. Once we had dry enough weather, the roof was addressed and **************' apartment was repaired. Again this was done within the time frame required by Oklahoma Law.
After ************** moved out, within a week or so, I toured the apartment with a gentleman that does our patch and paint work. We both noted areas throughout the apartment that needed to be repaired. We also noted two lights that were out and under his lease agreement the tenant is responsible for replacing. Such repairs have been completed this weekend. I have received his invoice.
My wife did a walk through this morning. Several areas were noted that needed to be cleaned. The cleaning people started the job at approximately 1:30 this afternoon. We asked for an expedited invoice which has been provided.
As noted in our initial response in the email copied above, Mr. ****** did not pay his April rent on time in accordance with the terms of his lease. The lease states that rent is due on the first and considered delinquent after 3 business days and each day thereafter carries a late fee of $25. Upon further review, ************** paid his April rent in two amounts, one on April 22nd and the remainder on May 3rd. The monthly rent has to be paid in full and therefore late fees would be calculated from April 4th to May 3rd a period of 30 days. At $25 per day such late fees are $750. As indicated above, we were led to believe that ************** was paid by the Agency for rent and late fees. By the terms of the lease, Section 4.B., this amount can be deducted from his deposit.
In reality, the amount owed DWB LLC is calculated as follows:
Deposit $450.00
Patch and Paint $120.00
Cleaning service 130.00
Lights [ 2@ $4.50 ] 9.00
Late fees 750.00
Total charges 1,009.00
Amount owed DWB LLC $ 559.00
We will be providing ************** with this information and providing copies of the two invoices. At the same time, we will request payment for the outstanding amount.

Under ******** Law we have 45 days to return monies owed. We are well within that time frame. The unit is being cleaned today and we were advised by the painter he had the unit ready for cleaning this past weekend.
When we first met, ************** was combative and wanted to argue about every aspect of what had previously been explained to him and agreed to. We offered to allow him out of the lease and to return his deposit. He declined.
In addition to the above ************** in April contacted me to state he would need help paying his rent and that he had contacted an agency for assistance. I spoke with the person from the agency and explained the lease required $25 a day in late rent fees. It was my understanding in talking to her and ************** that such late fees would be included in the assistance payment. ************** was approximately three weeks late with the April rent and late fees were never paid to me. He apparently retained those amounts. When I asked ************** about the late fees in late April, early May he told me he was not having this conversation and he turned and walked away. Due to the late fees not being paid he continues to not be in compliance with his lease.
We decided to provide proper notice in accordance with the lease not to renew his lease and he was properly informed.
