      On January 2, 2023 I signed a contract with C1 Construction LLC to build me a house outside of **************** for $167,185, to be completed by 1/2/2024 with a payment schedule (attached). I found this builder had a BBB A+ rating with no complaints.I made the first 4 payments at the times agreed for a total of $131,456. The C1 contractor (*********************) then started telling me money was tight and asked for money in advance. To keep the construction moving I advanced ************** $35,000 for a total of $156,456. He is now telling me he's run out of money and is asking for either more money or if I would buy materials such as *************** so he can install them. I informed him there will be no more money until he gets caught up on the contract. He has hauled off his construction trailers and when I called him he said he couldn't do anything unless he got more money. He also mentioned I could *** and he'd just file bankruptcy.I looked up his license ******* which shows he has an EXPIRED electrical contractor's license and no builder license. I'm sure this means he's not bonded either which he advertises that he is.I want ************** to finish building my house and I'll be glad to pay him when he gets caught up on the payment schedule.Currently, there is no siding, no windows, no plumbing, no HVAC, no interior walls, no cabinets and no flooring. If C1 can't finish the job my second option would be a refund of at least $35,000 and for C1 to hire another contractor to finish the job.

      *** contracted to build a house for **** and *********************, The contracted amount was $167,000. I built them a 80x30 house including a 30x30 garage with a poured slab the house is 2x6 construction it has been cheated and wrapped the roof has been decked and we've installed a metal roof The house is built over a 48 x30 basement with 8-in thick walls 8 ft tall. We still have $10,000 left on the contract. Unfortunately due to inflation COVID whatever else we are underfunded on this project it has gone over budget we probably need about another ****** to finish. The house is going to be worth probably about $500,000 they can go to the bank and get a little bit more money so we can finish the project they're unwilling to do that they're unwilling to take of the $10,000 they have left and buy materials directly and have them delivered to their property so we can finish I've explained to them I'm sorry but we are out of money on this project. I thought we could get it done for the 167 I was wrong The project is more like around a $250,000 project at least I've told them they could go and get bids from other contractors just get rough estimates of what they thought building a house like this was such a massive basement would cost and consider the fact that you're in ****** out in the middle of nowhere.I'm willing to work with them they've been nice people I haven't done them wrong I have not done anything but build them a house The house is there it's ready to be finished it's just going to take a little bit more money.

      I am rejecting this response because:   

      As I mentioned I advanced C1 Construction $35,000 ahead of the payment schedule. Since I advanced this money nothing has been purchased to continue building the house meaning ************** should still have the $35,000 that he was advanced. This being said, there is no way I will advance any more money to C1 Construction.

      As ************** states in the attached text:

      "Just to reiterate it's $15,000 to get the insulation, drywall, all the windows and exterior doors another $3,500 for garage door with opener".

      Windows, doors and drywall are what was supposed to be purchased with the $35K advance. C1 needs to buy supplies and finish building my house or refund the $35K advance so I can find another contractor to finish it.

      I have explained to them many times now that the project was over budget it cost more than expected to do the basement and the money that was paid in advance of our regular schedule payments went towards plywood siding decking metal roofing. Rafters ceiling joist and they were aware where we were at on the project and that we needed more money.

      After having the house inspected by a competent builder, I will not allow C-1 construction to work on it. To make things right, C-1 should pay for another contractor to fix all the mistakes as well as  paying the difference between C-1's bid and what it costs to complete the building.

      Year of 2023 Paid owner of company money for materials. No materials showed up. Owner took our money to purchase materials, which he never purchased nor did he refund us the money back. Seldom did he show up to do the work he was paid to do. Paid owner to do work, he failed in providing work he was paid to do. We weren't refunded for that either. Discussed with owner the fact that we paid him money, but he never did the work he was contracted to do, nor did he purchase the materials. Owner went to our property when nobody was around. He proceeded to pack up everything he could, then abandoned the job. Saying "you can take me to court, but you won't get any money back. I'll just file bankruptcy on my business. You will get nothing." Contract was voided. He still repeatedly tried demanding more money claiming he was out of money. He refused to continue if more money wasnt paid to him. He was not able to account for the money we paid him, stated "money is all gone." This business owner has been the most unprofessional, unethical, dishonest individual I've met. Based on my experience, with the owner of this company, he totally scammed us for money & continued to try for more. He displayed complete disregard to the contract & his responsibility.
