Took my money. Didn't deliver building as promised.

      Business response

      12/15/2022

Mr. ******** was unable to provide the required access to deliver the building. As stated in the purchase agreement he signed on 7/25/2022 **** ******** must provide adequate access to the site by removing limbs, removing fences, and other obstructions. We at Better Built Structures require a minimum opening 2' wider then the building, 4' for a 14'& 16'wide buildings.
Upon on arrival the driver was unable to get the building down the road to property. Because the building was undeliverable Mr. ******** stated he didn't want the building. We placed it on our sales lot in the Muskogee area. A restocking fee was assessed to Mr. ******** and a refund was issued.

The 16’ wide building was attempted to be delivered on 9/12/22. There was not enough clearance to get the building on to the customer’s property.

The customer had been informed he would need an additional 4’ than the width of the building to be able to deliver the building to his property. When the driver arrived to attempt delivery, there was less width than the width of the building. The driver stated he would possibly be able to get a 12’ wide building on to Mr. ********’s property but not the 16’ wide building. This driver has been on staff for years with Better Built Structures and is expertly trained and qualified to deliver our structures.

They have given me no money back. They are liars and cheats. I never signed any agreement. That signature was imported I was never made aware of the clearance.

I ordered two buildings last year. They were delivered late, much later than expected. The first payment, upon repeated request, was adjusted some, but not to the same degree that the buildings were delivered late. They ensured that the payment was still due in the same month as originally set, despite the extended delay of receiving the buildings. One building was damaged by the delivery guy. He didn't care. The other one was never properly set in place and had a gap of light coming in around the doorway, leading to rain coming inside the building. Since my son lived in the smaller building, he put flooring down. The rain ruined this and some of his belongings. It would flow under the bed in which he slept, creating a health hazard. The drafty door made it extremely cold for him throughout the winter. My husband was upset with everything on contract *****. I made the mistake of paying on the account when I meant to pay on another, so unfortunately, I paid two additional payments unintentionally. The building wasn't being used during this time. Now that the building has been repossessed, I am receiving a bill for past due payments, late fees and repossession fees. This was a rent to own building. In my experience with other companies, these final invoices are only due if I want the building back. However, I continue to receive phone calls regarding this invoice. I never want to do business with Better Built Structures or Kenwood Buildings again. Unfortunately, I still owe on the leaky building, so I am still having to make payments on it. Fortunately, my son has moved to another state, but I'm still attempting to keep his building for him. I don't feel that I owe for the invoice on account #*****. I honestly paid them nearly $500 more than I ever intended. I definitely do not feel that I owe them more. Any help is greatly appreciated! (please see attached)

Business Response /* (1000, 8, 2022/06/21) */ Thank you for notifying our office of this complaint. This is the first our office has heard of our customer's dissatisfaction. Better Built Structures, LLC is the manufacturer of the Portable Structures that our customer is referring to in this complaint. The warranty on the structure would cover defects in workmanship or materials. The customer has never contacted our office for a repair. Kenwood Buildings is the company that leases the structure to our customer. All complaints regarding the lease-to-own agreement, changing payment dates, billing adjustments, etc would need to be directed to Kenwood Buildings. Please have the customer contact our office or email pictures and a description of the repair needed to *********************. We will be glad to service her request.

Signed an agreement in march 2021 to purchase a 16x40 utility shed from betterbuilt structures of Sapulpa oklahoma for a cash purchase "COD" I was informed by salesman at *******-Checotah ******** lot that final payment would be electronic processed off the #'s on check that was processed for the deposit at the time of delivery. Deposit was processed thru bank info ie check the same month. I was to take delivery approximately may 1. April 19 or so got a call from BBS asking im ready for delivery i accepted delivery which was set for 3-4 days later as transport permits... Had to be in place. Took delivery on april 22. Signed delivery paper on my way to building my home happy happy. Then first of November 2021 recieved a call from ******* from BBS claiming i messed up the final payment on my purchase after a bit of talking with him he admitted that final payment wasn't submitted until late October 2021 and was never processed in April/May as agreed to in the agreement as it states "COD Payment will be debited from costumer's account upon delivery of building" and they took in their own accord to process the payment in late October which is not agreed to under the agreement. Was never contacted until after they couldn't just snag their mistake from the account. After few conversations with ****** i went to their office in Sapulpa to try to help rectify this situation at hand now. No i didn't inform them they hadn't recieved payment but that was their part of the agreement. No i do not have the 10k now but made face to face effort of full face value of agreement to BBS and they rejected all my offerings to settle this matter. Repossession is the only resolve i feel BBS wants from this agreement. I know i have very little legal standings on this matter but if an agreement only applys to only 1 party in the agreement not both that agreement should be void.

Business Response /* (1000, 8, 2021/12/21) */ The customer owed the remaining balance, and initially, did not want to pay after our attempt at processing. After some back and forth, the customer stated that he "was not responsible" for the remaining balance as it was not in the timeframe which he was expecting--as the customer no longer had the available funds. Eventually, the customer sought council in the matter, or did due diligence, and changed their position. We have since come to a payment agreement in which the total sum of $10,000.00 remaining will be paid monthly to complete the agreement.
