      2/10/2023. This company first quoted me and amount for ball joints, and then attempted to charge me twice the amount they originally quoted. The business committed to providing me the service of replacing my lower and upper ball joints. I recently took my car to another professional company, and they said that the ball joints were not replaced, possibly cleaned off if that. Japanese ************ committed fraud because they did not actually replace my ball joints.

      This is a response to the above customer's complain. 

      First and foremost I would like to be clear that here at Japanese ************ we do not cheat or try to fraud people. We have been in business for 25 years and we starve for customer's satisfaction and after reading this letter you will see that we go over and beyond for our customer's satisfaction. please refer to the attachments.  

      When ************* came in and requested to have the ball joints replaced. We did replace them, a value of $1655.69 See (exhibit 3). We told her  because she is a returned customer we would drop the price for her, which we actually did. From $1655.69 to $1000.00. When she picked up the vehicle on Feb 10th she paid the $1000.00 (exhibit 1) and left. On March 6th almost a month later she came back and said she didn't think she would need to pay $1000.00 and regret paying that much back in Feb 10th. So, Because we care about our customers so much we decided to take a lost on the work and credit her back another $300.00 (exhibit 2) in the end of the day we actually charged ************* $696.29 only, which is a third of was originally due. 

      Today ************* is asking for the $696.29 back because she thinks we cleaned out the ball joints and didn't replace them. We did replace the parts please see the purchase order (exhibit 4 & 5). If they don't look new? well that's because they were installed 11 months ago. therefore they would not look new today.  I really hope this brings clarity to the matter.

      Feb 10, 2023 Amount charged $1000.79 Business committed to repairing ball joints and bleeding the breaks for quote of $500-600 They gave me the initial quote. They did my ball joints. And then they charged me $1000.79. I never received a new quote. My written consent for the price and work was not obtained. This is in violation of ORS 646A.486 which states that if the final charge is over 10% or $200 over the original quote, whichever is less, notification to the customer must occur and written consent must be obtained.

      I just spoke to my service manager and he said you were never quoted a price when you dropped the vehicle off. I just looked up the job again and it is actually $1000.00 job. As a curtesy we would be more than happy to split it with you. we can refund you $300.00 for the misunderstanding. Please feel free to come in to our office with the same credit card you used and we can refund you $300.00 back.

      For the following reason, I am requesting a refund in full for the services performed by Japanese Auto **************************** Engine Sales AKA Asian Auto Repair and Foreign Engines that failed not once but twice, work not performed as agreed up, and expenses incurred for a total amount of $1,484.05. 1.March 2022, first replacement of valve gaskets and ************* steering assembly 2.March 2022, did not complete front end alignment as agreed upon 3.March 2022, did not clean engine and did not credit me for that work 4.June 2022, valve gaskets failure 5.June 2022, top engine plate, one s**** not original to the car and one s**** missing (there are a total of 4 screws to hold the plate in place) 6.June 2022, s**** head stripped on the drivers side engine plate cover 7.June 2022, plate cover on side of engine broker under the stripped s**** head 8.December 2022 valve gaskets failed for a third time 9.December 2022, air is leaking from the manifold on the passenger side 10.December 2022 ************* assembly failed from first install, March 2022 11.December 2022, bolt missing from engine, drivers side 12.The changing of warranties from the first to the second repair Original charge - March 24, 2022: $1,296.56 Front-end alignment with ******************* March 29-2022: $ ***** Cleaning of Engine with Midas December 2022 $ ***** Total: $1,484.05 March 2022, I left my vehicle with Japanese Auto **************************** Engine Sales a few days later for 3 full days to repair. They agreed to replacing the valve gaskets, ************* steering assembly, complete the front-end alignment, change the transmission fluid, and clean the engine for $1,500.00. After it was finished, **** called me to pick the vehicle up. When I got there, **** handed me some documents and I paid for this work. As I was reviewing their documentation, I realized there was no mention of their warranty. I asked **** where this can be found. He handed me a piece of paper that appears to be a manufactures warranty information on something completely unrelated to what they did for me. Bottom line, their documentation has NO warranty information for customers. Asked **** to hand write on my documents their warranty, which states parts and labor covered for 1 year. In addition to there being no warranty information, there was also nothing about the front-end alignment, the cleaning of the engine or changing of the transmission fluid. When questioned, **** said he didnt have enough time to take it over to ******************* for the front-end alignment or clean the oil from the engine. When I asked if the transmission fluid was changed, he stated he did it, but didnt put it on their documentation. June 2022, less than 3 months later, I was disappointed to find oil on my garage floor again. When looking at the engine, I could clearly see the oil on the passenger side where the valve gasket is located. I immediately called **** at Japanese Auto **************************** Engine Sale, took it back to them that day. Left it for 2 full days to correct. When **** called me to pick it up, he said that I owed them $570.00 dollars. I asked why. He said that their warranty only covers parts and labor for the first 3 months. I said, thats not what you stated the first time, it was one-year parts and labor. He said he was wrong, his brother corrected him, and he was still learning the business. I then pointed out to **** that it hadnt even been a full 3 months since the first time that he did the work. December 14, 2022, work failed again. Both the gasket work and ************* assembly leaking oil.

      We simply cant refund money for work that was done 10 months ago. specially for what the customer is stating the issues are. claiming a missing bolt or striped bolt which may not even be something we did. according to the customer, No one has worked on this vehicle since the day it was purchased in 2022 (11 years ago), I find that very hard to believe specially when I am actually in that line of business.  Requesting a refund on a leak in the rack and pinion, we have stated to the customer she is more then welcome to bring the vehicle in for us to remove that rack and ***** and send it back to the supplier to have it warrantied out. But she is refusing to. She wants us to refund her while keeping all the parts that we paid for out of our own pockets. We have tried to be fair to the customer but she is being unreasonable. we stand by our word, if she wants to have the rack and ***** replaced? we would be more then welling to do that for her free of charge, even though it has been over 10 months now. I think we are being more than fair at this point.

      I am rejecting this response because:

      1.  First off, the valve gaskets were redone by them in June of 2022 after they had already been done in March 2022. 

      2.  You may have been in the business for years, but you haven't been the owner of this vehicle.  As I stated to you earlier, I've owned the vehicle for 21 years, it was 2 years old when I purchased it and as I stated prior there has NEVER been any work done to the engine.  I have records to prove this.

      3.  The rack and ***** that's leaking from your installation has to be used as a core replacement when I have it replaced.  I paid for it, NOT you, it belongs to me.

      4.  With respect to you being "reasonable" how is reasonable for a consumer to have to go through 3 times of your poor workmanship?  You wouldn't hire me back if I failed to do work on something you owned after my work had failed twice prior.  It's reasonable to request a refund, NO one should have to be subjected to more poor workmanship, leaving their vehicle for days, or being told things like it's the gasket between the transmissin and engine when it SO OBVIOUS where the oil is coming from and it's been confirmed because as I told you earlier I paid to have a dye put into the engine oil and the oil with the die clearly is coming from the same gaskets you've already replaced twice.  In additon, it unrealistic to think that a consumer should believe that oil from the rack & pinion is the same oil from the engine...THEY AREN'T.  As you stated in your response, you've been in the "line of business" this is something you should already have known.

      Clearly, this is a waste of time.  And to say that you are being reasonable when you've already had 2 chances to get it right, isn't what a reasonable person would agree too.

      No matter how many times they say it's 10 months old, I have their paperwork that shows they redid the valve gaskets in June of 2022.  Obviously they don't know how to count.  No problem, I filed with Washington County today a small claim to take them to court, in which they will be presented with their own documentation.  You'll never win.

       

      PS.  How is this been "Addressed" when the Defendant has met their obligations under their own warranty information?

      I am sorry but you can't just write on an invoice with your own hand writing (one year warranty) and expect us to honor it. I think a judge would be the best solution to find an ending to this.

      I took my car in to bet an engine swapped and new engine came cracked so owner offered to rebuild it for same price. Rebuild is done but they advise me car doesnt start correct. They thought it was ECU but my trunk had to be broken to get to it so I had to do that myself then bring it back to the establishment. They also reduced price because I had to do stuff myself. They then took car back because it had even more issues than before and recently they called me and told me that it ran good and its ready. I drove it a little then when I got onto highway car stalled. I didnt want to call them for a bit because I wanted to figure out what to do. I just got off the phone with them and he cussed me out accusing me of messing my own car up and refusing to fix his mistakes on my car. He had also told me he test drove my car going 60 in a 45 and I do not appreciate them driving my car wreck less.

      My name is ***************, owner of Japanese ************* Please see attached invoices. We are not sure what ******************** is doing with the car when he has it in his garage. We have done more then enough trying to solve this issue to the point of loosing money in the process.  his **** came to $5111.00 and we only charged him $1850.00. ******************* is young a man who stated he liked working on his own car. which tells me he keeps messing up things on that car only to bring it back to us to fix for free. Several days after picking up his car. he called us and said that as soon as he took from my shop the car stopped. My question to him is Why didnt you call that same second. why wait several days to let me know that the car stopped as soon as soon as you picked it up. That on its own tells me he is messing with the car to try to make it faster or something. We have a video showing the engine is running prefect. we took it for a test drive to confirm it was done correctly. And in reply to ******************* stating we were driving his car recklessly? yes we did tell him that we went 60 miles an hour. but we didnt state where we did that, he only assumed we did it in a 45MPH  zone. No sir we took your car to the Freeway and made sure its in great running condition. 

       

      In conclusion, The very first time we saw this car was on a tow truck not running. we have no idea what kind of electrical issues or computer issues it had before we even started working on it. Our job was to replace his engine. which was done and confirmed to be a great engine with 220 PSI  by my shop, ****************, and ***************** & electric. The job that the customer had requested originally was complete for less then the third of the price.

      I am rejecting this response because:
      I have not done anything to modify this car. I am not trying to make it faster I just want my car to run. The first time they sent my car back to me, they told me it was probably an ecu issue. All I did was replace my trunk, key cylinder lock latch and ecu. I had put a little bit of bondo on some cracks on my bumpers and I had taken it for a test drive. None of that would have broken something or messed up the car. It was still having the issues where it would stall. Al told me to take my car back to his shop after I replaced the ecu which I did and he fixed a few issues I was having because of the work they did which I understand and appreciate. Sometimes jobs dont go the right way and sometimes you may not notice it I understand. But why I am rejecting this is because before I took my car to them I drove from my house going to work when the engine spun a rod bearing and seized. It wasnt stalling or anything before I took it to them. I also do not appreciate them lying. Al did in fact tell me it was TV highway where he supposedly went 60 mph which is probably a lie because I cant get it past ***** rpm without it stalling. The phone-call was not recorded due to me and al arguing on the business phone then him calling me on his personal phone probably so it wasnt being recorded see picture attached. Al also still did not admit to not taking my car to a ****** dealership. I called the dealership he told me he took it to and they told me Al hadnt been there since 2011 and they havent worked on my car before.
