    I was building a new home and thought a hot tub would be a great addition to the new home. I saw a ad on the ******** Marketplace from *******************. I reached out to him and agreed to order Tropic Seas Tahiti hot tub. He required a $2,000 deposit so I met him at ************************* in northwest ******** to give him a check and get a receipt for the $2,000 deposit. The new home project was taking much longer that I was initially told so I contacted **** to let him know and he said no problem that he'd sell the tub I ordered to another customer and when the house project is moving forward to let him know and he'll get a duplicate tub ordered. **** supposedly ordered the duplicate tub without my knowledge or approval. The home job got delayed again so I asked **** for a refund of my deposit and when the time comes he's earned my business. He flat out refused to refund my deposit because he said the manufacturer kept the deposit. I called Tropic Seas Spas manufacturing facility in ********* and they told me they don't collect a deposit from dealers. I called **** and told him what I found out and he agreed to meet me halfway and refund $1000.00. I agreed to that but the next day he took back that offer saying he spoke to his attorney and he owes me nothing! **** did offer to sell me a hot tub at his cost moving forward. The problem is that he is no longer a dealer for Tropic Seas Spas. He only sells Strong Spas which don't offer a comparable tub as the Tahiti I sought out to purchase. I gave him the $2,000.00 deposit on 5/20/20 and nearly two years later I'm still out $2,000.00 and have no option to order the hot tub I want. Refunding my deposit is morally and ethically the right thing to do. I have all text messaged saved from the last two years.
